Compliance Evaluator Recommendations and Technical Assistance. 199. The Compliance Evaluator may make recommendations to the Parties regarding actions necessary to ensure timely Substantial and Effective Compliance with this Agreement and its underlying objectives. Such recommendations may include a recommendation to modify a provision of this Agreement, a recommendation for additional training in any area related to this Agreement, or a recommendation to seek technical assistance. The Compliance Evaluator does not have the authority to modify this Agreement through these recommendations, or any other means, without meeting the requirements for modification under paragraph 236 below. 200. In addition to such recommendations, the Compliance Evaluator may also provide limited technical assistance consistent with the Compliance Evaluator’s responsibilities under this Agreement.

  • TECHNICAL EVALUATION (a) Detailed technical evaluation shall be carried out by Purchase Committee pursuant to conditions in the tender document to determine the substantial responsiveness of each tender. For this clause, the substantially responsive bid is one that conforms to all the eligibility and terms and condition of the tender without any material deviation. The Institute’s determination of bid’s responsiveness is to be based on the contents of the bid itself without recourse to extrinsic evidence.
