CONCESSION PREMISES. 4.1 The concession shall be conducted within the Cerritos Tennis Center, as shown on the attached Exhibit D, Site Plan, attached hereinafter and incorporated herein by reference. 4.2 Any improvements, additions, alterations, or changes to the concession premises shall be subject to: prior approval by the Director securing of applicable permits; and compliance with such terms and conditions as may be imposed by the Director. Any construction shall be at Concessionaire's sole expense. 4.3 Concessionaire shall provide regular maintenance under section 9.11, Concessionaire Maintenance Responsibilities. As shown on the attached Exhibit D, Site Plan, restrooms adjacent to pro shop shall be maintained by the Department’s maintenance contractors in lieu of concessionaire. Concessionaire shall conduct periodic visual inspection of restrooms supplies and general cleanliness during business hours. Supplies will be provided by the County. 4.4 Ownership of all structures, buildings or improvements constructed by Concessionaire upon the concession premises and all alterations, additions or betterment's thereto, shall become the property of the County without compensation being paid therefor, subject to the rights granted to the Concessionaire hereinabove. Upon termination thereof, whether by expiration of the term, cancellation, forfeiture or otherwise, the Director may require the Concessionaire to remove said structures, buildings and/or improvements upon written notice ninety (90) days prior to the date of termination of this Agreement. Should Concessionaire fail to remove said structures, buildings and improvements, same may be sold, removed or demolished, and Concessionaire shall reimburse County for any cost or expense in connection there with in excess of any consideration received by County as a result of said sale, removal or demolition.
CONCESSION PREMISES. The Concession premises (hereinafter called the Premises) shall include the Concession Building, Restrooms and the area immediately surrounding the facility as shown in Exhibit E.
CONCESSION PREMISES. The Township hereby grants to the Operator the right to use and occupy the concession booth space (the ‘premises’) in the Tyendinaga Recreation Complex, located at ▇▇▇ ▇▇▇▇▇▇▇▇▇ ▇▇▇▇, Shannonville, ON for the sole purpose of a concession operation.
CONCESSION PREMISES. The Concession Premises will be delivered to the Licensee in turn- key condition. Licensee shall have use of City-provided furniture, fixtures, and equipment (“FF&E”) during the term of the License, but all such FF&E shall remain owned by the City. A list of City-provided FF&E is attached hereto as Exhibit B. Licensee accepts the FF&E in the condition they are in at the time of delivery of the Concession Premises and shall thereafter maintain them in good condition and repair. Any alterations to the interior space of the Concession Premises shall be at Licensee’s expense and shall be subject to the prior written approval of City. Licensee shall be responsible for providing any FF&E above and beyond that provided by City (with City’s prior written approval) and all other equipment, interior and exterior signs, merchandise, and labor necessary to operate the Concession Premises. Exterior signs shall be subject to City approval. The Recreation Services Manager may allow storage of Licensee’s equipment, tools, and instrumentalities in the Concession Premises if there is available space. Contractor may only store its equipment, tools, and instrumentalities in an area approved by the Recreation Services Manager (or designee). The City is not responsible for damage to, theft of, or loss of any equipment, tools, and/or instrumentalities owned and/or rented by Licensee. • Licensee is responsible for returning all equipment, tools, and instrumentalities to their proper place after catering events and performing services under this Agreement. Neither the City nor city staff are responsible for items left out after an event.
CONCESSION PREMISES. The SFRAA hereby grants to Concessionaire, and Concessionaire hereby accepts, the right to use the Concession Premises, in as-is condition, for the purposes of conducting the Concession. Nothing herein shall be deemed to be a leasing of the Concession Premises to the Concessionaire, but the Concessionaire is granted herein only the right, privilege, and obligation to operate, manage, and maintain said Concession Premises, the SFRAA retaining unto itself the possession thereof.

Licensee accepts the concession premises in its present physical condition, and agrees to make no demands upon County for any improvements or alterations thereof. 2.04 Any improvements, additions, alterations, or changes to the concession premises shall be subject to prior approval by the Director; securing of applicable permits; and compliance with such terms and conditions as may be imposed by the Director. Any construction shall be at Licensee's expense. 2.05 Licensee hereby acknowledges the title of the State of California, County, and/or any other public agencies having jurisdiction thereover, in and to the premises and the improvements located thereon, and covenants and agrees never to assail, contest or resist said title. 2.06 Ownership of all structures, buildings or improvements constructed by Licensee upon the concession premises and all alterations, additions or betterments thereto, shall become the property of the State without compensation being paid therefor, subject to the rights granted to the Licensee hereinabove. CONCESSION PREMISES. For purposes of operating the Concession rights under this Agreement, the Concessionaire shall have the exclusive use of the Concession Premises. The “Concession Premises” are those portions of Green Lake Park described as follows: the boat rental building, the area between the rear of the boat rental building and the tennis court fence, the boat staging area at the shoreline, and an outdoor concession stand area adjacent to the building, all as depicted on Exhibit 1 - Green Lake Boat Rental and Food Concession Premises. The Concession Premises are located on a portion of Green Lake Park legally described on Exhibit 2 – Green Lake Photos and Legal Description. The Concession Premises may be relocated or adjusted at any time at the option of the Department, subject to acceptance by the Concessionaire.
CONCESSION PREMISES. The Concession Premises shall include buildings within the "Deadwood Event Complex". Such property shall hereafter be referred to as the "Concession Premises" or the "Premises". Concessionaire shall have the exclusive right to the use of the Concession Spaces within the premises buildings, and the rights to the public areas and seating areas to sell food and beverage (excluding alcohol), herewith defined as the "Common Areas" in this Agreement. A-3 PERIOD OF PERFORMANCE; TERM OF AGREEMENT This Agreement shall commence upon execution by the Deadwood City Commission and shall be for a maximum of five (5) years. The parties have the option of entering into an additional five (5) year agreement by mutual agreement of CITY and CONCESSIONAIRE based on performance. The annual renewal rate to be paid by CONCESSIONAIRE for the five (5) year period will be determined, changed or adjusted by mutual agreement, in writing, of the parties. If the parties cannot agree to the annual rate prior to the end of the original contract term, the annual rate to be paid by CONCESSIONAIRE shall remain the same for the next five (5) year option. The other terms and conditions of this contract will continue in effect unless modified in writing by agreement of the parties. The Concession right and privilege granted herein for the term as specified, is given in exchange for the Concessionaire's: a. Making monthly payments called for under the terms of this Agreement. b. Providing concession equipment and services sufficient to reasonably satisfy the intent of this Agreement that Concessionaire operate a concession for all of the events scheduled at the Deadwood Event Complex. c. Satisfying all other conditions and requirements imposed on the Concessionaire by this Agreement.
