Conduct of Tenant. Tenant acknowledges that Landlord, its parent, subsidiaries and affiliates have a reputation for offering high-quality entertainment and/or services to the public, and that it and its affiliates are subject to regulation and licensing, and desire to maintain their reputation and receive positive publicity. Tenant therefore agrees that throughout the Term of this Lease, it and its officers and management will not conduct themselves in a manner that adversely affects or is detrimental to the reputation or image of Landlord or its affiliates, and will not directly or indirectly make any oral, written or recorded public statement or comment that is disparaging, critical, defamatory or otherwise not in the best interests of Landlord. Landlord shall use its good faith business judgment in determining whether Tenant's conduct or that of its officers and management adversely affects Landlord or its affiliates, and, upon such determination, Landlord shall have the right to terminate this Lease upon notice to Tenant without liability to either party if Tenant does not cause such activity to be terminated and use its reasonable best efforts to remedy or mitigate any material harm done to Landlord within thirty (30) days after such notice from Landlord. The termination or removal of any person responsible for actions or statements prohibited by this Section 8.18 shall constitute full compliance with Tenant's obligations to remedy such default.
Conduct of Tenant. Conduct of Tenant. If Tenant generates, uses, transports, stores, treats or disposes of any Hazardous Materials:
(a) Tenant shall, at its own cost and expense, comply with all Environmental laws relating to hazardous or toxic materials;
(b) Tenant shall (i) not dispose of any Hazardous Materials in dumpsters or trash containers; (ii) not discharge any Hazardous Materials into drains or sewers; (iii) not cause or allow the release, discharge, emission or run-off of any Hazardous Materials to air, to surface waters, to the Land, to ground water, whether directly or indirectly; (iv) at Tenant’s own cost and expense arrange for the lawful transportation and off-site disposal of all Hazardous Materials generated by Tenant; (v) provide secondary containment around all Hazardous Materials storage containers, storage facilities and above ground storage tanks; (vi) conduct all necessary environmental inspections, such as, but not limited to, asbestos inspections prior to any renovation or demolition, as required by 40 CFR Part 61 and provide copies of all such reports to Landlord; (vii) comply with all reporting requirements under any local, state or federal ordinance, statute or regulation, such as, but not limited to, toxics inventory reporting under the Emergency Planning and Community Right-to-Know Act, the provisions under 40 CFR Part 61, or various regulations controlling the emissions into the atmosphere of volatile organic compounds and provide copies of all such reports and notifications to Landlord; (viii) use only highly skilled people to address all environmental issues associated with this Lease, that such people and all employees of Tenant shall receive all required training or certification under any local, state or federal law specifically mentioned or alluded to in this Lease;
(c) Tenant shall promptly provide Landlord with copies of all communications, permits or agreements with any governmental authority or agency (federal, state or local) or any private entity relating in any way to the violation or alleged violation of any Environmental Laws or to any violation of Tenant’s obligations under subparagraph (b) above;
(d) Landlord and Landlord’s agents and employees shall have the right to enter the Premises upon reasonable notice and/or conduct appropriate tests for the purpose of ascertaining that Tenant complies with all applicable laws, rules or permits relating in any way to the presence of Hazardous Materials on the Premises; and

Conduct of Tenant. Tenant shall use the Premises in a careful, safe and proper manner. Tenant shall comply with all laws, rules, regulations, orders and requirements of all governmental authorities applicable to Tenant’s particular use of the Premises.
Conduct of Tenant. TENANT(S) and TENANT’S family, servants, employees, agents, visitors and guests shall observe faithfully and comply strictly with the Rules and Regulations governing LANDLORD’S property and such other reasonable Rules and Regulations as LANDLORD or its Agent may from time to time adopt. Conduct of Tenant. Tenant covenants and agrees to:
a. Pay the Rent on the days and times and at the place that the same are payable.
b. Keep the Property in good order and repair, reasonable wear and tear excepted. Tenant agrees to surrender the Property in the same condition in which Tenant has herein agreed to keep the same during this Lease.
c. Comply with all applicable statutes, rules, regulations, and laws.
d. Peaceably deliver up and surrender possession of the Property to Landlord at the expiration or sooner termination of this Lease.
Conduct of Tenant. 5.01 Tenant agrees that Tenant and Tenant's permitted assignees or sub-lessees shall use the Leased Premises for the sole and exclusive purpose set forth in paragraph 1.07. The use of the Leased Premises shall also be in accordance with the ordinances and regulations of the municipality in which the Leased Premises is located. Without limitation of the foregoing, Tenant agrees that the Leased Premises will not be used for any purpose other than that provided above. Tenant agrees to comply with all rules and regulations, of which Tenant is given notice, reasonably established by Landlord for the governing of conduct of tenants in general in the Project. The current rules and regulations for tenants in the Project are set forth in Exhibit C.
5.02 Tenant agrees that Tenant will not keep, use, sell or offer for sale in or upon the Leased Premises any article which may be prohibited by the standard form of fire insurance policy. Tenant agrees to pay any increase in premiums for fire and extended and/or all risk coverage insurance that may be charged during the Term of this Lease on the amount of such insurance which may be carried by Landlord on the Project, resulting from the type of equipment, merchandise or services used by Tenant in the Leased Premises, whether or not Landlord has consented to the same. In determining whether increased premiums are the result of Tenant's use of the Leased Premises, a schedule issued by the organization making the insurance rate on the Leased Premises, showing the various components of such rate, shall be conclusive evidence of the several items and charges which make up the fire insurance rate on the Leased Premises and the Project.
5.03 Tenant shall not commit or suffer to be committed any waste upon the Leased Premises or Project or any nuisance or other act or thing which may materially and unreasonably disturb the quiet enjoyment of any other tenant in the Project.
5.04 Tenant shall, at Tenant's sole cost and expense, comply with all of the requirements of all county, municipal, state, federal and other applicable governmental authorities, now in force or which may hereafter be in force and not being reasonably disputed by Tenant, pertaining to the Tenant's use of the Leased Premises or any act therein by Tenant. Conduct of Tenant. If Tenant, with the prior written authorization of Landlord, which authorization may be granted or denied by Landlord in its sole and absolute discretion, generates, uses, transports, stores, treats, or disposes of any Hazardous Material in, on or around the Project:
34 A. Tenant shall, at its own cost and expense, comply with all Environmental Laws relating to any Hazardous Material used, stored, generated or disposed of in, on or around the Project;
Conduct of Tenant. Tenant must have regard and consideration for the comfort and convenience of other tenants in the building and surrounding area in which the Premises are located. Tenant will be responsible for the acts and conduct of ▇▇▇▇▇▇'s fam- ily, visitors, and any other persons on the Premises with Tenant's permission or in the building or surrounding area in which the Premises are located. ▇▇▇▇▇▇ agrees to comply with the Rules and Regulations, which are attached to this Lease as Schedule A, and which are incorporated as terms and conditions of this Lease. Tenant is also responsible to ensure that ▇▇▇▇▇▇'s family, visitors, and any other persons on the Premises with ▇▇▇▇▇▇'s permission shall comply with the Rules and Regulations. During the term of the Lease or during any renewal term, Landlord may propose reasonable changes and amendments to the Rules and Regulations for Tenant's approval; Tenant shall not unreasonably withhold approval of proposed changes and amendments. ▇▇▇▇▇▇ agrees to accept any reasonable changes and amendments that Landlord may make to the Rules and Regulations at the beginning of any renewal term of the Lease. Failure to abide by the Rules and Regulations is a breach of this Lease. Conduct of Tenant. As between LANDLORD and TENANT, TENANT shall bear sole responsibility for violations of and/or compliance with regulations and order of the Occupational Safety and Health Administration (OSHA), Pennsylvania Department of Environmental Resources (PA DER), and similar governmental bodies relating to the health, safety and welfare of its premises, employees and the effect of same upon the surrounding community. TENANT affirmatively agrees to comply with those conditions and regulations of Pennsylvania Department of Commerce attached hereto or otherwise referred to in Exhibit E.
