Common use of Conduct of the Parties Clause in Contracts

Conduct of the Parties. 18.3.1 In order to facilitate this dispute resolution procedure: (a) the Party with the dispute must notify the other Party at the earliest opportunity of the problem; (b) throughout all stages of the procedure all relevant facts must be clearly identified and recorded; and (c) sensible time limits must be allowed for completion of the various stages of discussion. However, the Parties must co-operate to ensure that the dispute resolution procedure is carried out as quickly as possible. 18.3.2 The parties will: (a) if the AIRC makes an arbitrated decision and an appeal is not lodged under clause 1.6 of Appendix C abide by and give full effect to the arbitrated decision; and (b) if an appeal is lodged under clause 1.6 of Appendix C, abide by and give full effect to the decision of the Full Bench of the AIRC in determining the appeal.
