Consequences for Not Achieving ACO Scale Targets. If the State fails to achieve the ACO Scale Targets described in sections 4.a, 4.b, and 4.c for two consecutive Performance Years (excluding Performance Year 0), the State shall submit, for CMS approval, a CAP. The State’s CAP submission shall be in accordance with the requirements set forth in section 21, and shall include methodology on how the State will improve its performance against the ACO Scale Targets.
