Common use of Continued Eligibility Clause in Contracts

Continued Eligibility. The Grantee will continue to meet the following requirements throughout the Agreement term: 17.1. If the Grantee is not a public agency or federally recognized tribe, the Grantee must be recognized by the Internal Revenue Service (IRS) as a 501(c)(3) organization. If the Grantee loses 501(c)(3) status during the Agreement term as a result of automatic revocation for failure to file reports, the Grantee remains provisionally eligible to receive funding but, within thirty (30) days of notice of termination, the Grantee must reapply for 501(c)(3) status and provide proof of reapplication to WSDA FA. 17.2. This Agreement terminates upon the Grantee's failure to timely provide proof of reapplication to WSDA FA, unless the Grantee can show good cause for the failure to reapply. The Grantee will forward documentation of IRS recognition of 501(c)(3) status to WSDA FA within 180 days of the reapplication date. This Agreement terminates if the Grantee's tax-exempt status is denied, or the Grantee fails to timely forward proof of status. 17.3. If the Grantee is not a public agency or federally recognized tribe, the Grantee must be registered with the Washington Secretary of State’s office as a nonprofit corporation. 17.4. Churches and religious organizations associated with a church are exempt from the obligations of Paragraph 17 except for Paragraph 17.3.

Churches and religious organizations associated with a church are exempt from the obligations of Paragraph 17 except for with the exception of Paragraph 17.317.2.
