Common use of Continuous / Discontinuous Service Clause in Contracts

Continuous / Discontinuous Service. For the purposes of this Article only, all service within the Public Service, as defined in the Public Service Labour Relations Act whether continuous or discontinuous, shall count toward vacation leave earnings except where a person who on leaving the Public Service takes or has taken severance pay, retiring leave or a cash gratuity in lieu of retiring leave. However, the above exception shall not apply to an employee who receives severance pay on lay-off and is reappointed to the Public Service within one (I) year following the date of layoff. Accumulation of Vacation Leave Effective July an employee shall earn in respect of each fiscal year, annual vacation leave with pay at he following rates for each calendar month in which receives at least seventy-five (75) hours’ nine decimal three seven five (9.375) hours until the month in which the anniversary of the employee’s eighth year of service occurs; twelve decimal five 2.5) hours commencing with the month in which the employee’s eighth anniversary of service occurs; thirteen decimal seven five (13.75) hours commencing with the month in which the employee’s sixteenth anniversary of service occurs; fourteen decimal three seven five (14.375) hours commencing with the month in which the employee’s seventeenth (I anniversary of service occurs; fifteen decimal six two five (15.625) hours commencing with the month in which the employee’s eighteenth anniversary of service occurs. sixteen decimal eight seven five (16.875) hours commencing with the month in which the employee’s twenty-seventh anniversary of service occurs; eighteen decimal seven five (18.75) hours commencing with the month in which the employee’s twenty-eighth anniversary of service occurs; Leave provisions of clause which are in excess of fifteen (15) days per fiscal year shall be granted on a pro rata basis during the fiscal year in which the employee completes the required years of service.
