Common use of Contractor Responsibility for Performance Clause in Contracts

Contractor Responsibility for Performance. Notwithstanding Contractor’s submission and WSP’s acceptance of a Corrective Action Plan, Contractor remains responsible for achieving all Performance Standards and compliance with all other obligations under this Contract. Further, WSP’s acceptance of a Corrective Action Plan under this Section shall not: Excuse Contractor’s prior performance; Relieve Contractor of its duty to comply with performance standards; or Prohibit WSP from assessing additional remedies or pursuing other appropriate remedies for continued substandard performance.
