Contractor to search cause. 17.5.1 The Authority’s Engineer may instruct the Contractor to examine the cause of any Defect in the Works or part thereof before the expiry of the Defects Liability Period. 17.5.2 In the event any Defect identified under Clause 17.5.1 is attributable to the Contractor, the Contractor shall rectify such Defect within the period specified by the Authority’s Engineer, and shall bear the cost of the examination and rectification of such Defect. 17.5.3 In the event such Defect is not attributable to the Contractor, the Authority’s Engineer shall, after due consultation with the Authority and the Contractor, determine the costs incurred by the Contractor on such examination and notify the same to the Contractor, with a copy to the Authority, and the Contractor shall be entitled to payment of such costs by the Authority.
