Costs of Delivery. There is hereby established with the Certificate Agent the Costs of Delivery Fund. Amounts in the Costs of Delivery Fund shall be invested in Permitted Investments until expended. The Certificate Agent will make payment by check or wire transfer from amounts on deposit in the Costs of Delivery Fund for costs of delivery as may be requested by the Office of Education upon receipt by the Certificate Agent of a requisition signed by an authorized officer of the Office of Education. In the event the total of any requisition exceeds the amount then on deposit in the Costs of Delivery Fund, the Certificate Agent shall promptly notify the Office of Education of the shortfall, and await further instructions from the Office of Education. On the earliest of the date on which all amounts in the Costs of Delivery Fund are expended or the first business day equal to or greater than 180 calendar days subsequent to the date of delivery of the Notes or as designated by the Office of Education, the Certificate Agent shall close the Costs of Delivery Fund and any remainder from the Costs of Delivery Fund shall be refunded to the Treasurer for subsequent pro rata credit to the Participants.
