Cut and Fill Clause Samples

The Cut and Fill clause defines the responsibilities and procedures for earthmoving activities where soil or rock is excavated (cut) from one area and used to fill (fill) another area to achieve desired land elevations. In practice, this clause specifies how quantities are measured, the quality of materials to be used for fill, and the methods for disposing of excess or unsuitable material. Its core function is to ensure that site grading is performed efficiently and safely, minimizing disputes over material handling and ensuring the finished site meets design specifications.
Cut and Fill. 10.5.1 No cut and fill limits shall apply to the building footprint area, roadway rights-of- way or the construction and maintenance of Water Quality Controls and detention ponds. 10.5.2 No cut and fill in excess of 4 feet shall be allowed in the Critical Water Quality Zone or the Water Quality Transition Zone. 10.5.3 Cut and fill in excess of 4 feet must be structurally contained in accordance with the City’s Environmental Criteria Manual. 10.5.4 In the Uplands Zone, cut or fill between 4 and 8 feet may be administratively approved. Cut or fill in excess of 8 feet must be approved by the Land Use Commission. 10.5.5 Criteria for allowing cut or fill between 4 and 8 feet shall include, but not be limited to: 10.5.5.1 No adverse impact on a Critical Environmental Feature; 10.5.5.2 No adverse impact on water quality; or 10.5.5.3 The site has been previously disturbed by manmade activities. 10.5.6 The fill limitation shall not apply to: 10.5.6.1 Fill placed under foundations and containment walls perpendicular to the round, or with pier and beam construction if the fill is structurally contained; or 10.5.6.2 Back fill for utility construction or wastewater drain fields. 10.5.7 Cut and fill for roadways shall be contained within the right-of-way.
Cut and Fill. Contractor shall prepare detailed Site preparation drawings showing cut and fill requirements, and rough and finished grade elevations respectively, for use by the Site preparation subcontractor.

An interpretive sign is a sign that is a type of informational display that provides context and explanations about a site, artifact, or cultural heritage and is not visible from a public right of way for vehicular traffic. Temporary signage will be installed at each location for approval of the site plan. Permanent education signage will be developed with students and installed at a later date. Permanent signs are not a requirement for certificate of occupancy. 10.2.4.2 As shown in the Environmental Enhancements planning Exhibit A, approximately 500,000 square feet of prairie habitat restoration will be provided using native prairie species, native soils and other habitat enhancements as approved by the Director of Watershed Protection. 10.2.4.3 All plant material will be 100% native or adapted species and selected from Exhibit B (Plant List). Alternative plants may be provided as reviewed and approved by the City of Austin Arborist. 10.2.4.4 The project will provide a minimum of (2) vehicle charging stations and (80) bicycle parking spots. 10.2.4.5 Rainwater and AC condensate will be collected and used for landscape irrigation. 10.2.4.6 The project will comply with bird friendly design standards by meeting the minimum requirements of the Austin Energy Green Building criteria for light pollution reduction and bird collision deterrence. 10.2.4.7 The project will provide an Integrated Pest Management Plan.

  • Record and File Retention Grantee must maintain these files for five years after the end of the applicable fiscal year, except that, if any litigation, claim or audit is commenced with respect to the transactions documented by such files before the end of the aforementioned five-year period and extends beyond the expiration of the five-year period, these files must be retained until all litigation, claims, or audit findings involving the files have been resolved.

  • Recording and Filing The County and Borrower shall cause this Agreement, and all amendments and supplements to it, to be recorded in the Official Records of the County of Contra Costa.
