Daily rest breaks. Each employee covered by this Agreement will be entitled to a rest period of ten minutes, without deduction of pay, in the first half of the day. An additional rest period of ten minutes will be allowed in the second half of the day. 18.3.1. Where at least 95% of employees on site are in favour and the employer agree the two daily rest breaks mentioned above (smoko breaks) may be combined into one 30 minutes paid break in lieu of the daily rest breaks and the meal break provided for in clause 18.1 provided that no employee shall work more than 4 hours without a break. 18.3.2. Where the Union gives the employer notice of an intention to enter site for the purpose of holding discussions during the employee’s breaks in compliance with relevant legislation, then the employees will revert to two breaks for that day i.e. one 20 minute paid rest break and a 30 minute meal break. The employer will consult with the Union about the timing of these breaks to enable the Union to meet the employees in a manner efficient and effective to all parties to this agreement. 18.3.3. By enabling employees to take a single break during the workday, the employer will not cause the Union to be disadvantaged in its ability to consult with its members in accordance with the relevant legislation. 18.3.4.   • Rest Break (a) An employee working overtime must be allowed a rest break of 20 minutes without deduction of pay after each four hours of overtime worked if the employee is to continue work after the rest break. (b) Where a day worker is required to work overtime on a Saturday, Sunday or Public Holiday or on a rostered day off, the first rest break will be paid at the employee's ordinary rate of pay.

  • Rest Breaks Employees shall receive a fifteen (15) minute break during each four (4) hours worked. It is the Employer's intention to provide uninterrupted rest breaks.

  • MEAL PERIODS AND REST BREAKS 4.1 Except when required for urgent or emergency work and except as provided in 4.2 no employee shall be required to work for more than five hours continuously without being allowed a meal break of not less than half an hour. 4.2 An employee unable to be relieved from work for a meal break shall be allowed to have a meal on duty and this period shall be regarded as working time. 4.3 Except where provided for in 4.2 an employee unable to take a meal after five hours’ duty shall be paid at overtime rates from the expiry of five hours until the time when a meal can be taken. 4.4 During the meal break or rest breaks prescribed above, free tea, coffee, milk and sugar shall be supplied by the employer. Where it is impractical to supply tea, coffee, milk and sugar free of charge, an allowance of $1.48 per week in lieu shall be paid. This allowance shall continue during all periods of leave except leave without pay. 4.5 Rest breaks of 10 minutes each for morning tea, afternoon tea or supper, where these occur during duty, shall be allowed as time worked.

  • Retainage for Unacceptable Corrective Action Plan or Plan Failure If the corrective action plan is unacceptable to the Department or Customer, or implementation of the plan fails to remedy the performance deficiencies, the Department or Customer will retain ten percent (10%) of the total invoice amount. The retainage will be withheld until the Contractor resolves the performance deficiencies. If the performance deficiencies are resolved, the Contractor may invoice the Department or Customer for the retained amount. If the Contractor fails to resolve the performance deficiencies, the retained amount will be forfeited to compensate the Department or Customer for the performance deficiencies.

  • Coffee Breaks The Company will provide two (2) fifteen (15) minute coffee breaks during each work day, one in the morning and one in the afternoon.
