The Date of Occupation clause establishes the specific date on which the tenant or buyer is entitled to take possession of the property. This clause typically outlines whether occupation is granted upon registration of transfer, completion of construction, or another agreed-upon milestone, and may specify any conditions that must be met before occupation is allowed. Its core practical function is to provide certainty and prevent disputes by clearly defining when the rights and responsibilities associated with occupation commence.
Date of Occupation. The date provided for in clause 5 of the Schedule to which this document forms Annexure ”1”;

Date of Occupation. The SELLER does not guarantee that the property will be ready for occupation on the anticipated date of occupation. Should the property not be available for occupation on such date the SELLER shall give the PURCHASER one calendar month written notice (as specified in clause 4.2) failing which the PURCHASER can accept that the property shall be available for occupation.
Date of Occupation. 6.1. In respect of completed units, the Date of Occupation shall be as set out in Item 4.1 of Annexure A; 6.2. In respect of units located in a phase of the Scheme still to be developed: 6.2.1. the Date of Occupation will be upon completion of the Unit. Completion of the Unit shall be certified by the Seller’s appointed architect who shall act in his/her capacity as an expert and not as an arbitrator; and 6.2.2. the Seller shall give the Occupant at least 90 (ninety) days’ written notice of the anticipated date upon which the Occupant’s Unit will be available for occupation. If the Seller, for whatever reason, withdraws its notice as aforesaid, then the Seller shall be entitled to notify another date as the Date of Occupation and the Seller shall not be required to again give notice as aforementioned.
