Common use of Deceptive Trade Practices Clause in Contracts

Deceptive Trade Practices. As partial consideration for the parties agreeing to enter into this Agreement, the parties each can and do expressly waive the provisions of all consumer protection Laws of the State of Texas, or any other state, applicable to this transaction that may be waived by the parties; it is not the intent of the parties to waive and the parties shall not waive any applicable Law or provision thereof which is prohibited by Law from being waived. Each party represents to the other that such party has had an adequate opportunity to review the preceding waiver provision, including the opportunity to submit the same to legal counsel for review and comment, and understands the rights being waived herein.
