DEFINITION OF INCOMPETENCY Sample Clauses

The Definition of Incompetency clause establishes the criteria and process for determining when an individual is legally or medically considered unable to manage their own affairs. Typically, this clause outlines who has the authority to make such a determination—such as a licensed physician or a court—and may specify the evidence required, like a written statement from a doctor. By clearly defining incompetency, the clause ensures that there is a standardized method for identifying when a person can no longer make decisions for themselves, thereby protecting their interests and providing guidance for the appointment of a guardian or the activation of powers of attorney.
