Denial of Performance Increase Sample Clauses
The Denial of Performance Increase clause prevents a party from demanding or receiving an increase in compensation or benefits for performing obligations already agreed upon in the contract. In practice, this means that even if circumstances change or additional effort is required, the party responsible for performance cannot claim extra payment unless the contract is formally amended. This clause ensures cost certainty for the paying party and protects against unexpected financial demands, thereby maintaining the original terms and budget of the agreement.
Denial of Performance Increase. The university shall give notification in writing of withholding of performance increases to all employees at least fifteen (15) days prior to the employee’s eligibility date. When the performance increase is to be withheld, the reasons therefor shall be given in writing and will be subject to “just cause” standards. Any grievances for denial of annual performance pay increases will be processed under Article 17 - Discipline and Discharge.
