Description of Property. (a) ▇▇▇▇▇▇ agrees to sell to ▇▇▇▇▇ and ▇▇▇▇▇ agrees to buy from Seller the following property: (1) The Unit in the Project described in Article I above. The Unit is more fully described in the Declaration and shown on the Condominium Map. (2) An undivided percentage common interest ("common interest") in all common elements of the Project, as described in Article I above. The common elements are more fully described in the Declaration and shown on the Condominium Map. Each unit owner will be an owner of the common elements as a tenant in common with the other unit owners in the Project. Each unit owner will also have the rights and easements appurtenant to his unit as described in the Declaration and shown on the Condominium Map. (3) The furnishings, fixtures and appliances located in the Unit. These are described in Article I above. The Buyer's interest in the Property will be subject to all of the terms, conditions, rights and agreements mentioned in (i) any document affecting the Project which is filed in the Office of the Assistant Registrar of the Land Court of the State of Hawaii and/or recorded in the Bureau of Conveyances of the State of Hawaii, (ii) the Koa Ridge Covenants, (iii) the Declaration of Merger, (iv) the Condominium Unit Deed described below, or (v) the Declaration or the By-Laws, as amended from time to time.
