Common use of Description of Scope Clause in Contracts

Description of Scope. The Promotional Merchandise available for purchase through this Contract shall include the following Categories, which include but are not limited to: Category Number Category Name Category Description Category 1 Bags and Totes Backpacks, cooler bags, drawstring sports packs, shopping/grocery totes, lunch bags, computer bags, and travel bags Category 2 Beverage and Drinkware Aluminum, plastic, and stainless bottles, sports bottles, travel mugs and tumblers, ceramic mugs, plastic cups, can coolers, and coasters Category 6 Wellness and Safety Buttons, hand sanitizers, first aid kits, lip balm, pedometers, and sunscreen Category 7 Customized Supplies Badges, badge holders, lanyards, highlighters, key chains, markers, notepads, pencils, pens, phone accessories, and stress balls The Contractor shall only provide Promotional Merchandise in Category(ies) which they have received an award. The Contractor may only provide Promotional Merchandise in Category 8 if awarded in at least two Categories from 1-7. The Contractor shall only provide Promotional Merchandise in Category 8 that are not contemplated in Categories 1-7. Products purchased from this Contract are not to be used for resale. Clothing, shoes, and other apparel items are NOT included in this Contract. Notwithstanding any awarded Categories and pursuant to section 946.515 of F.S., agency purchases of Promotional Merchandise of comparable price, quality, and performance specifications certified by or if available from Prison Rehabilitative Industries and Diversified Enterprises, Inc. (PRIDE) shall be purchased from PRIDE. Notwithstanding any awarded Categories and pursuant to section 413.036 of F.S., agency purchases of Promotional Merchandise of comparable price and quality, and available on the procurement list and available within a reasonable delivery time shall be from the Central Nonprofit Agency (CNA or RESPECT of Florida).
