Common use of Design and Plans and Specifications Clause in Contracts

Design and Plans and Specifications. Developer shall, as soon as practicable, provide the UG with plans and specifications for the Improvements (collectively, the "Plans and Specifications"), which Plans and Specifications shall include cost estimates for the Improvements, detailed specifications of materials, and the design of which is compatible with the Project Area 3 Plan, and all Applicable Laws and Requirements. Developer recognizes, stipulates and agrees that the Project is subject to the UG's planning and zoning approval process, and the Plans and Specifications will be presented to and subject to approval by the UG in accordance with Applicable Laws and Requirements. There shall be no Material Changes to the Plans and Specifications subsequent to the initial approval other than in accordance with Applicable Laws and Requirements and this Agreement. (a) Developer shall, as soon as practicable provide the UG with a landscape plan, which sets forth a detailed plan for landscaping of the Site (the "Landscape Plan"). The Landscape Plan must be approved by the UG in accordance with Applicable Laws and Requirements as described above in Section 2.2(d) hereof, and upon such approval, shall be attached to this Agreement as Exhibit G. (b) The UG reserves the right to, upon prior written notice to Developer, have its engineer, UG staff or other agents or employees inspect all work in respect of which a Certificate of Expenditure is submitted, to examine the Developer’s and other’s records relating to all costs of Improvements to be paid, and to obtain from such parties such other information as is reasonably necessary for the UG to evaluate compliance with the terms hereof.

Design and Plans and Specifications. Developer recognizes, stipulates and agrees that the Project is subject to the UG's planning and zoning approval process, and the Plans and Specifications will be presented to and subject to approval by the UG in accordance with Applicable Laws and Requirementsappropriate Government Authorities as part of the construction permitting process. There Without the prior written approval of the appropriate Government Authorities, there shall be no Material Changes to the Plans and Specifications subsequent to Specifications. Developer and the initial approval other than in accordance with Applicable Laws and Requirements and this Agreement.UG further agree as follows: (a) Developer shall, as soon as practicable (but in all events prior to the earlier of (i) submission of an application for a building permit, or (ii) the date of the STAR Bond Closing), provide the UG with a detailed design criteria that sets forth the architectural design of the Improvements that are a part of, and the building materials to be used in, the construction of the Homefield Project (the "Design Criteria"). The Design Criteria must be approved by the UG in its reasonable discretion, and upon such approval, shall be attached to this Agreement as Exhibit 14. (b) Developer shall, as soon as practicable (but in all events prior to the earlier of (i) submission of an application for a building permit, or (ii) the date of the STAR Bond Closing), provide the UG with a landscape plan, which sets forth a detailed plan for landscaping of the Site Homefield Project (the "Landscape Plan"). The Landscape Plan must be approved by the UG in accordance with Applicable Laws and Requirements as described above in Section 2.2(d) hereofits reasonable discretion, and upon such approval, shall be attached to this Agreement as Exhibit G.
