The Designation of Subcontractors clause establishes the process by which a party, typically the contractor, identifies and obtains approval for any subcontractors they intend to use on a project. Designation of Subcontractors a. In compliance with the Subletting and Subcontracting Fair Practices Act (Chapter 2, Section 4100 et seq. Division 5, Title 1 of the Government Code of the State of California) and any amendments thereof, each bidder shall set forth: (a) the name and the location of the place of business of each subcontractor who will perform work or labor or render service to Contractor in or about the construction of the Project under this Agreement or a subcontractor licensed by the State of California who, under subcontract to Contractor, spatially fabricates and installs a portion of the Project according to the Plans and Specifications in an amount in excess of one-half of one percent of Contractor’s total bid, and (b) the portion of the Work which will be done by each subcontractor. b. If Contractor fails to specify a subcontractor or if Contractor specifies more than one subcontractor for the same portion of the Work performed for the Project in excess of one-half of one percent of Contractor’s total bid, he shall be deemed to have agreed that he is fully qualified to perform that portion himself, and that he shall perform that portion himself. c. Contractor shall not: (a) substitute any subcontractor, (b) permit any subcontract to be voluntarily assigned or transferred or allow it to be performed by any one other than the original subcontractor listed in the original bid, or (c) sublet or subcontract any portion of the Work on the Project in excess of one-half of one percent of Contractor’s total bid as to which the original bid did not designate a subcontractor, except as authorized by HACSB. d. Subletting or subcontracting of any portion of the Work on the Project in excess of one-half of one percent of Contractor’s total bid as to which no subcontractor has been designated in the original bid shall only be permitted in cases of public record of HACSB wherein HACSB has set forth the facts constituting the emergency or necessity.
Designation of Subcontractors. CONTRACTOR must submit with its bid, a Designation of Subcontractors pursuant to the Subletting and Subcontracting Fair Practices Act. If CONTRACTOR specifies more than one subcontractor for the same portion of work or fails to specify a subcontractor, and such portion of the work exceeds one-half of one percent of the total bid, CONTRACTOR agrees that it is fully qualified to perform and shall perform such work itself, unless CONTRACTOR provides for substitution or addition of subcontractors. Substitution or addition of subcontractors shall be permitted only as authorized under the Subletting and Subcontracting Fair Practices Act, Public Contract Code Section 4100, et. seq.
Designation of Subcontractors. The Contractor may suggest a Subcontractor in accordance with Article 2.2.8. Alternatively, the Principal may designate (a) Subcontractor(s) for specific lots. Once the Agreement has been concluded, the Contractor will not be permitted to enter into a partnership with a third partner without the Principal’s prior written consent.
Designation of Subcontractors. Prior to each Commencement Date, the Parties will develop and prepare and/or augment a list of subcontractors to which Customer Consents and that the Parties agree may be engaged by Supplier to perform and deliver the part or portion of the Services indicated on such list. Upon Customer’s request, Supplier shall promptly provide to Customer information regarding such proposed new or replacement subcontractors in order to permit Customer to determine whether to grant its Consent to such delegation or subcontract, or change of delegation or subcontract. Such information shall include the scope of the Services to be delegated, the experience, financial status and resources of the proposed subcontractors, and Supplier’s selection criteria for the proposed subcontractor and conclusions regarding its selections. In addition, Supplier shall not disclose any Company Information of Customer to any subcontractor unless and until such subcontractor has agreed in writing to protect and treat the confidentiality of such Company Information in a manner equivalent to that required of Supplier by Section 11.

  • Selection of Subcontractors Procurement of Materials and Leasing of Equipment: The contractor shall not discriminate on the grounds of race, color, religion, sex, sexual orientation, gender identity, national origin, age, or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract. a. The contractor shall notify all potential subcontractors, suppliers, and lessors of their EEO obligations under this contract. b. The contractor will use good faith efforts to ensure subcontractor compliance with their EEO obligations.

  • PAYMENT OF SUBCONTRACTORS Contractor shall pay any of its subcontractors not later than seven (7) days after receipt of any progress payment, unless otherwise agreed to in writing, the respective amounts allowed Contractor on account of the work performed by subcontractor(s), to the extent of each subcontractor’s interest therein, except as otherwise provided in Business and Professions Code Section 7108.5.

  • Use of Subcontractors Nothing in this Appendix 2 shall prevent the Interconnection Parties from utilizing the services of subcontractors as they deem appropriate to perform their respective obligations hereunder, provided, however, that each Interconnection Party shall require its subcontractors to comply with all applicable terms and conditions of this Appendix 2 in providing such services.
