Deviation from Specifications Sample Clauses

The 'Deviation from Specifications' clause defines the procedures and consequences when a party delivers goods, services, or work that does not fully comply with the agreed-upon specifications in a contract. Typically, this clause outlines the steps to be taken if deviations are discovered, such as requiring corrective action, imposing penalties, or allowing the other party to reject the non-conforming deliverables. Its core function is to ensure that contractual standards are maintained and to provide a clear mechanism for addressing and remedying any failures to meet those standards, thereby protecting the interests of the party expecting performance as specified.

The HCDA will use its best efforts to coordinate the date and time of such interviews, if required, for a time that is suitable to all parties. Failure to participate in the interview, if designated as a short list candidate, will be grounds for the Proposer to be considered non-responsive and the proposal will be eliminated from further consideration.
