Common use of Diligent Completion Clause in Contracts

Diligent Completion. The Company agrees to use its commercially reasonable efforts to cause the acquisition, construction and installation of the Project to be completed and to create 30 full-time jobs in connection with the Company’s operations in the County within the Investment Period; however, notwithstanding anything contained in this Fee Agreement to the contrary, the Company shall not be obligated to complete, or cause the completion of, the acquisition, construction, and installation of the Project and may terminate this Fee Agreement with respect to all or a portion of the Project as set forth in Article X herein.
