Common use of Diligent Completion Clause in Contracts

Diligent Completion. As a condition to qualifying for the Payments- in-Lieu-of-Taxes and other benefits to which the Company is entitled hereunder, the Company acknowledges that it will be required to use its reasonable efforts to cause the acquisition, construction and installation of the Project to be completed; however, notwithstanding anything contained in this Fee Agreement to the contrary, neither the Company nor any Sponsor Affiliate shall be obligated to complete the construction and acquisition of the Project and may terminate this Agreement with respect to all or portion of the Project at any time as set forth in Article X herein.
