If the disclosure to such Restricted Person’s consultant or designee may not be made without violating the Disclosure Limitations, in the good faith, reasonable determination of Borrower and its regulatory counsel, then the Borrower agrees that it will use, or will cause its Subsidiaries to use, as applicable, commercially reasonable efforts to determine an acceptable alternative to achieve the intended objective of the requested disclosure.   • DISCLAIMERS; EXCLUSIONS; LIMITATIONS Subject to §4, neither party makes any warranties (express, implied, or otherwise), including implied warranties of merchantability, non-infringement, fitness for a particular purpose, or title, related to its performance or anything else provided under this Agreement. Neither party will be liable for any special, incidental, punitive, or consequential damages of any kind for any reason whatsoever relating to this Agreement, even if such damages were reasonably foreseeable.
