The Discretionary Service clause defines the provider's right to determine the scope, manner, or timing of services delivered under the agreement, based on their professional judgment or business needs. In practice, this means the service provider can choose which specific services to offer, adjust how those services are performed, or decide when to provide them, as long as they remain within the general framework of the contract. This clause is essential for granting flexibility to the provider, allowing them to adapt their services to changing circumstances or client needs without breaching the agreement.
Discretionary Service. Under the Overdraft Service, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. We may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of this service and subject to this Agreement. This overdraft service is not a line of credit, is not guaranteed, and is independent of any loan arrangement you may have with us. We will not pay an overdraft for you in excess of any limit we have established for your account type. Also, we may refuse to pay an overdraft for you at any time, even if we have previously paid overdrafts for you.

Even if you have opted in to Overdraft Protection, we are not obligated to pay any Card purchase transaction presented for payment that exceeds the Available Balance of your account. The Privilege Pay service will be provided for ATM and debit card purchase transactions only if you request it by providing us a one-time opt- in for these transactions. Under the Privilege Pay service, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds. We may, as a discretionary service and not as a right of yours or our obligation to you, pay overdrafts up to an approved overdraft limit under the terms of this service and subject to this Agreement. Via your mailed (or e-mailed, if you have so requested) periodic statement, we will notify you of any insufficient funds, checks, or items paid or unpaid and returned that you may have. However, we have no obligation to notify you before we pay or return any item.

To be eligible for Overdraft Privilege you must satisfy the following conditions: keep a positive balance in your account at least once every 30 days; you must not be more that 14 days past due on any loan or delinquent on any other obligation with the Credit Union or subject to any legal order, levy or bankruptcy proceeding; you must not have an outstanding balance on an Overdraft Repayment Plan; you must not be subject to a ChexSystems or other negative indicator or an extended hold on your checking account or any other account relationship with us. Overdraft Privilege is not available to minors, dormant accounts, Debit Card Checking, POD, Fiduciary or Escrow accounts. Under the Overdraft Privilege service, we are not obligated to pay any check or item presented for payment if your account does not contain sufficient funds.
