DURATION AND SCOPE OF AGREEMENT. Section 1. The effective date of this Agreement shall be the date signed by the Parties, subject to the approval of the USAID Administrator, or his/her designee, or the 31st day after the date signed by the Parties, whichever comes sooner, in accordance with Section 7114 (c)(1)(2) and (3) of the Statute. Subject to Article 2, Section 2.b, this agreement shall remain in full force and effect for three (3) years from the effective date. Thereafter, the Agreement shall be automatically renewed for additional one year periods, unless either Party gives written notice to the other within 120 to 60 calendar days prior to the anniversary date of this Agreement of its intention to amend, supplement, or terminate this Agreement. In the event notice is given, the Parties shall begin negotiations no later than thirty (30) calendar days after the anniversary date. This Agreement will remain in place until a successor agreement or any changes become effective. Section 2. This Agreement shall be amended or supplemented as follows: a. The Parties shall amend and/or supplement this Agreement as required to reflect changes mandated by law. Such changes shall become controlling at the time the law becomes effective. b. Changes not mandated by law or executive order may be proposed by either Party at any time, but will only be negotiated and implemented if both Parties mutually agree. Written requests for such amendment(s) by either Party must include a written summary of the proposed amendment(s). Section 3. Amendments and supplemental Agreements shall become effective on the date signed by both Parties, subject to the approval of the USAID Administrator, or his/her designee, or on the 31st day after the date signed by the Parties (whichever comes sooner) in accordance with Section 7114(c)(1)(2) and (3) of the Statute. They shall remain effective concurrent with the CBA. Section 4. The Agency will make an electronic link of the Agreement available on the USAID internal and external website, and twenty five (25) printed copies will be furnished to the Union.
