Early Operating Period Clause Samples

Early Operating Period. 4.4.1 The Seller may procure the issue of the Unit Completion Form by the Independent Engineer, at its own cost and in each case in accordance with this clause 4.4.1 (Early Operating Period), in respect of each Unit (if applicable) which the Seller anticipates will generate and deliver Early Operating Energy to the Delivery Point, which notice shall be in the form of Schedule 2 Part 1 and 2 (Facility Unit Completion Forms).
Early Operating Period. 5.4.1 The Seller may procure the issue of the Unit Completion Form by the Independent Engineer, at its own cost and in each case in accordance with this Clause 5.4 (Early Operating Period), in respect of each Unit (if applicable) which the Seller anticipates will generate and deliver Early Operating Energy to the Delivery Point, which notice shall be in the form of Schedule 2 Part 2 (Unit Completion Form). 5.4.2 Pursuant to Clause 5.4.1 and upon the Independent Engineer determining Unit Completion and receipt of the relevant Unit Completion Form, the Seller may in respect of such Unit issue the Notice of Commencement of Unit to the Buyer at least ten (10) Business Days before the Seller anticipates that the relevant Unit or Units will begin generation and delivery of early Operating Energy to the Delivery Point, which notice shall be in the form of Schedule 2 Part 4 (Form of Notice of Commencement of Unit). 5.4.3 Until 00:00 hours on the Unit Commencement Date in respect of a Unit, the Buyer shall not be obliged to purchase Early Operating Energy generated by that Unit or to pay the Early Operating Energy Price in respect of any Early Operating Energy generated by that Unit.

Early Operating Period. The Early Operating Period will begin on the Signature Date and will terminate on the earlier of (i) the Commercial Operation Date, or (ii) the date the Agreement is terminated pursuant to the provisions of Clause 21 (Termination).

The Seller shall not be entitled to issue the first Notice of Commencement of Unit more than one hundred and eighty (180) days before the Scheduled COD. 4.4.2 Until 00:00 on the Unit Commencement Date in respect of a Unit, the Buyer shall not be obliged to purchase Early Operating Energy generated by that Unit or to pay the Early Operating Energy Rate in respect of any Early Operating Energy generated by that Unit.
Early Operating Period. 5.4.1 The Seller may issue the Notice of Commencement of the Facility to the Buyer at least fourteen (14) Days before the Seller anticipates that the Facility will begin generation and delivery of Early Operating Energy to the Delivery Point, which notice shall be in the form of Schedule 2 Part 3 (Form of Notice of Commencement of Facility). 5.4.2 The Seller shall not be entitled to issue the first Notice of Commencement of Facility more than one hundred and eighty (180) days before the Scheduled COD. 5.4.3 Until 00:00 on the Facility Commencement Date, the Buyer shall not be obliged to purchase Early Operating Energy generated by the Facility to pay the Early Operating Energy Rate in respect of any Early Operating Energy generated by the Facility.

  • Planning Period All observations must be conducted openly and with full knowledge of the employee.

  • Rental Period (a) Renter has the right to use the rental vehicle (“Vehicle”) until the return date indicated on the Rental Agreement Summary ("Rental Period"). (b) Owner may agree to extend the Rental Period orally or in writing ("Extended Rental Period") but the overall Rental Period may never be more than 88 days. The Extended Rental Period may be subject to higher charges and/or to additional security deposit which will be disclosed to Renter prior to the extension of the Rental Period. (c) Subject to the following conditions, Renter may choose to return the Vehicle before the end of the agreed Rental Period and thereby terminate this Rental Agreement early (and the Rental Period will be reduced accordingly). (i) If Renter has prepaid the Rental Costs (as defined in section 5) to qualify for a "special offer" rate, Renter may not be entitled to any refund due to early voluntary termination. (ii) If Renter has not prepaid the Rental Costs, early termination can have an impact on the daily rates and the other applicable charges if the originally agreed daily rates and applicable charges were conditioned upon the specifics of the original Rental Period. Owner recommends that Renter verify with Owner what impact an early termination has on the Rental Costs before returning the Vehicle early.

  • Billing Period The calendar month shall be the standard period for all charges and payments under this Agreement. On or before the fifteenth (15th) day following the end of each month, Seller shall render to Buyer an invoice for the payment obligations incurred hereunder during the preceding month, based on the Energy Delivered in the preceding month, and any RECs deposited in Buyer’s GIS account or a GIS account designated by Buyer to Seller in writing in the preceding month. Such invoice shall contain supporting detail for all charges reflected on the invoice, and Seller shall provide Buyer with additional supporting documentation and information as Buyer may request.

  • Subsequent Recalculation In the event the Internal Revenue Service adjusts the computation of the Company under Section 5.2 herein so that the Executive did not receive the greatest net benefit, the Company shall reimburse the Executive for the full amount necessary to make the Executive whole, plus a market rate of interest, as determined by the Committee, within 30 days after such adjustment.

  • Maximum Annual Operating Expense Limit The Maximum Annual Operating Expense Limit with respect to each Fund shall be the amount specified in Schedule A based on a percentage of the average daily net assets of each Fund.
