Effect of Non-Participating Class Members Sample Clauses
The 'Effect of Non-Participating Class Members' clause defines the legal status and rights of individuals who are part of a class in a class action lawsuit but do not actively participate in the proceedings. Typically, this clause clarifies whether these non-participating members are bound by the outcome of the case, such as a settlement or judgment, and whether they retain any rights to pursue separate claims. For example, it may specify that unless a class member opts out, they will be subject to the final resolution of the case. The core function of this clause is to ensure clarity regarding the legal consequences for class members who do not take an active role, thereby preventing future disputes and ensuring the enforceability of the class action's outcome.
