Effect of Reallocation. A. Reallocation to a Class with a Higher Salary Range Maximum 1. If the employee has performed the higher-level duties for at least six (6) months and meets the skills and abilities required of the position, the employee will remain in the position and retain their existing appointment status. 2. If the reallocation is the result of a change in the duties of the position and the employee has not performed the higher-level duties for at least six (6) months, the Employer must give the employee the opportunity to compete for the position if they possess the required skills and abilities. The Employer may choose to promote the employee without competition as long as the employee possesses the required skills and abilities. If the employee is not selected for the position, or does not have the required skills and abilities, the layoff procedure specified in Article 36, ▇▇▇▇▇▇ and Recall, of this Agreement will apply. If the employee is appointed to the position, they must serve a trial service period. B. Reallocation to a Class with an Equal Salary Range Maximum 1. If the employee has the skills and abilities required of the position, the employee will remain in the position and retain their existing appointment status. 2. If the employee does not meet the skills and abilities required of the position, the layoff procedure specified in Article 36, Layoff and Recall, of this Agreement will apply. C. Reallocation to a Class with a Lower Salary Range Maximum 1. If the employee has the skills and abilities required of the position and chooses to remain in the reallocated position, the employee will retain their existing appointment status and has the right to be placed on the Employer’s internal layoff list for the classification the employee held permanent status in prior to the reallocation. 2. If the employee chooses to vacate the position or does not have the skills and abilities required of the position, the layoff procedure specified in Article 36, Layoff and Recall, of this Agreement applies.

1. If the employee nurse has performed the higher-level duties for at least six twelve (612) months and meets has the skills and abilities required of the position, the employee nurse will remain in the position and retain their existing appointment status.
2. If the reallocation is the result of a change in the duties of the position and the employee nurse has not performed the higher-level duties for at least six twelve (612) months, the Employer must give the employee the opportunity to compete for the position if they possess the required skills will be filled in accordance with Section 30.1 of Article 30, Hiring and abilities. 1. If the employee nurse has the skills and abilities required of the position, the employee nurse will remain in the position and retain their existing appointment status.

C. Reallocation to a Class with a Lower Salary Range Maximum
1. If the employee nurse has the skills and abilities required of the position and chooses to remain in the reallocated position, the employee nurse will retain their existing appointment status and has the right to be placed on the Employeragency’s internal layoff list for the classification the employee held permanent status in prior to the reallocationreallocation and in the General Government Transition Pool Program.
2. If the employee nurse chooses to vacate the position or does not have the skills and abilities required of the position, the layoff procedure specified in Article 3628, Layoff and Recall, of this Agreement applieswill apply.
