Emergency Generator. (a) Tenant, at its sole cost and expense and subject to the terms of this Lease, shall have the right to operate and maintain life safety, emergency, and business sustainability generators and related equipment (collectively, the "Generators") located in the Leased Premises. Tenant shall operate and maintain the Generators in accordance with all federal, state and local laws and regulations and with any protective covenants. Tenant shall be solely responsible for obtaining any necessary permits and licenses required to operate and maintain the Generators and shall provide copies thereof to Landlord. Tenant shall at all times keep the Generators and the surrounding area in a clean and orderly condition. (b) Tenant, at its sole cost and expense, shall be responsible for removing non-life safety generators and the screening surrounding non-life safety generators and for restoring the Building and/or Common Areas affected by non-life safety generators and screening to their original condition after such removal. Tenant agrees, within thirty (30) days after written notice from Landlord, to remove the non-life safety generators and screening surrounding same in the event any governmental entity or applicable law or regulation requires removal thereof or Tenant fails to materially comply with the terms stated herein. Such removal shall be in accordance with all of the terms and conditions set forth herein. If Tenant fails to remove non-life safety generators and screening surrounding same from the Building or Common Areas upon expiration or earlier termination of the Lease, or after expiration of the thirty (30) day notice period provided above, non-life safety generators and screening surrounding same shall be deemed abandoned by Tenant and shall become the property of Landlord, or Landlord may remove the same at Tenant's expense.

Emergency Generator. Tenant, at Tenant’s sole cost and expense, shall install screening around the Generator, the size, location, design and manner of which shall be subject to the written approval of Landlord. Tenant shall at all times keep the Generators Generator and the surrounding area in a clean and orderly condition.

Emergency Generator. (a) TenantSo long as this lease is in full force and effect and Tenant is not in default hereunder beyond any applicable notice and cure periods, at its sole cost and expense and subject to the terms of this Lease, Tenant shall have the right to operate and maintain life safety, emergency, and business sustainability generators and related equipment (collectively, the "Generators") located in the Leased Premises. Tenant shall operate and maintain the Generators in accordance with all federal, state and local laws and regulations and with any protective covenants. Tenant shall at all times keep the Generators and the surrounding area in a clean and orderly condition.
(b) Tenantright, at its sole cost and expense, to install and maintain up to a 1200 KVA emergency generator adjacent to the Building serving the Premises, subject to the following terms and conditions: The location, design, construction, size, capacity and all other aspects of such generator shall be subject to Landlord’s prior approval, which approval shall not be unreasonably withheld, conditioned or delayed. All costs associated with installing and constructing such generator, including, without limitation, installation and connection of power feeds, cabling, pad site installation, and the like, shall be Tenant’s sole responsibility. However, at Tenant’s option, such costs may be paid out of the Tenant Improvement Allowances. The generator must comply with, and be installed in accordance with, all applicable governmental rules and regulations. Tenant shall shield or screen the generator from public view. In the event that the generator is located in the Parking Facility, any parking space(s) taken by the generator shall be counted towards the total number of parking spaces allocated to Tenant under this lease. The expense of maintaining and removing the generator shall be the sole cost and expense of Tenant. Tenant shall be responsible for removing non-life safety generators all costs and the screening surrounding non-life safety generators expenses associated with such generator and for restoring the Building and/or Common Areas affected by non-life safety generators and screening Tenant shall promptly repair any damage to their original condition after such removal. Tenant agrees, within thirty (30) days after written notice from Landlord, to remove the non-life safety generators and screening surrounding same in the event any governmental entity or applicable law or regulation requires removal thereof or Tenant fails to materially comply with the terms stated herein. Such removal shall be in accordance with all of the terms and conditions set forth herein. If Tenant fails to remove non-life safety generators and screening surrounding same from the Building or Common Areas upon the Land resulting from the installation, construction, maintenance or removal of such generator. Upon the termination or expiration or earlier termination of this lease, Tenant shall promptly remove the generator at its sole cost and expense. Tenant shall restore any portion of the Lease, Building or after expiration Land affected by the generator to substantially the same condition existing prior to the installation of the thirty (30) day notice period provided abovegenerator, non-life safety generators normal wear and screening surrounding same shall be deemed abandoned tear and damage by Tenant casualty and shall become the property of Landlord, or Landlord may remove the same at Tenant's expensecondemnation excepted.

Emergency Generator. (a) Tenant, at its sole cost So long as this Lease is in full force and expense and subject to effect the terms of this Lease, Tenant shall have the right to operate and maintain life safety, emergency, and business sustainability generators and related equipment (collectively, the "Generators") located in the Leased Premises. Tenant shall operate and maintain the Generators in accordance with all federal, state and local laws and regulations and with any protective covenants. Tenant shall be solely responsible for obtaining any necessary permits and licenses required to operate and maintain the Generators and shall provide copies thereof to Landlord. Tenant shall at all times keep the Generators and the surrounding area in a clean and orderly condition.
(b) Tenantright, at its sole cost and expense, to install and maintain an emergency generator serving the Leased Premises, subject to the following terms and conditions:
(a) The Landlord shall provide a generator pad near the Building loading dock in the approximate location as depicted on Schedule “G-4” attached hereto for the installation of the Tenant’s emergency generator as well as a fuel system for the generator. The design, construction, size, capacity and all other aspects of such generator shall be subject to Landlord’s prior approval, which approval shall not be unreasonably withheld. All costs associated with installing such generator, including without limitation, installation and connection of power feeds, cabling, pad site installation and removal, and the like, shall be Tenant’s sole responsibility. The generator must comply with, and be installed in accordance with, all applicable governmental rules and regulations.
(b) The Tenant shall shield or screen the generator from public view. In the event that the generator is located in the Parking Facility servicing the Building, any parking space(s) taken by the generator shall be counted towards the total number of parking spaces allocated to the Tenant under this Lease.
(c) The expense of installing, construction, maintaining and removing the generator shall be the sole cost and expense of Tenant. Tenant may use the Allowance to pay for such costs if available. Tenant shall be responsible for removing non-life safety generators all costs and the screening surrounding non-life safety generators expenses associated with such generator and for restoring Tenant shall promptly repair any damage to the Building and/or Common Areas affected by non-life safety generators and screening to their original condition after or the Property resulting from the installation, construction, maintenance or removal of such removalgenerator. Tenant agrees, shall promptly remove the generator at its sole cost and expense within thirty (30) days after written notice from Landlord, to remove the non-life safety generators and screening surrounding same in the event any governmental entity expiration or applicable law or regulation requires removal thereof or Tenant fails to materially comply with the terms stated herein. Such removal shall be in accordance with all termination of the terms and conditions set forth hereinLease Term. If Tenant fails to remove non-life safety generators and screening surrounding same from shall restore any portion of the Building or Common Areas upon Land affected by the generator to substantially the same condition existing prior to the installation of the generator, normal wear and tear excepted.
(d) The terms of this Special Stipulation No. VI shall survive the expiration or earlier termination of the this Lease, or after expiration of the thirty (30) day notice period provided above, non-life safety generators and screening surrounding same shall be deemed abandoned by Tenant and shall become the property of Landlord, or Landlord may remove the same at Tenant's expense.
