The vacation schedule will be posted in January and employees must complete the schedule prior to April 1st. The Hospital will then review the schedule and approve it by April 15th. Once it has been approved, changes can only be made by the mutual consent of the employee and the Hospital. Employees not selecting their vacations by April 1st may make a selection for a mutually agreeable time with the Department Head, which shall not affect employees approved as of April 15th. All vacation periods will be arranged with an employee's supervisor with consideration being given to the employee's wishes on a basis and the needs of the department. If an employee who leaves the employ of the Hospital does not provide two weeks' notice to the Hospital, he shall be paid the vacation allowance provided in the Employment Standards Act of Ontario.

Only if there is conflict in requests made in the first eight weeks after the schedule is posted, shall seniority prevail. The parties agree that any and all divisible surplus or excess, credits or refunds, or reimbursements under whatever name, that may arise, during the term of this Collective Agreement and result from a lower premium amount paid by the Hospital under the Ontario Health Insurance Act or any similar legislation, than the total amount paid the Hospital and the employee at the commencement of this Agreement as premium payments for present health services shall accrue to and for the benefit of the Hospital notwithstanding any legis- lation to the contrary, and particularly without limiting the generality, the Ontario Health Insurance Act or any legislation amending or replacing such Act in whole or in part.
