The 'Entitlements on Termination' clause defines the rights and benefits that each party is entitled to receive when a contract is ended, whether by expiration or early termination. Entitlements on Termination. (a) On termination of this agreement in accordance with clause 26.2 or 26.3, the Executive shall be entitled to receive from the Company:
(i) Pay in lieu of any accrued annual leave and/or long service leave to which the Executive is entitled up to and including date of termination;
(ii) Any payment in lieu of notice under clause 26.2;
(iii) Any applicable benefits due to the Executive pursuant to the provisions of any incentive plan if the Company determines the Executive is so entitled; and
(iv) Any outstanding Salary payments.
(b) Any entitlement to redundancy pay will be in accordance with the Company’s minimum obligations under the Fair Work Act 2009 (Cth).
(c) If the amount payable to the Executive in connection with termination of their employment would result in the Company breaching section 200B of the Corporations Act, then despite any other provision in this agreement, the amount payable to the Executive will be the maximum amount which may lawfully be paid without obtaining shareholder approval in accordance with the Corporations Act.
Entitlements on Termination. 38.2.1 Where an Employee is paid under the RDO system and has accrued a credit towards an RDO, such credit shall be taken into account in calculating wages due on termination.
38.2.2 Where notice has been given an Employee shall continue in employment until such notice expires.
38.2.3 The Employee shall terminate employment at one (1) week’s notice, at any time during the week, or by payment, or forfeiture as the case may be, of a week’s basic periodic rate of pay for nominal hours worked.
38.2.4 If the Employee fails to give notice the Employer has the right to withhold monies due to the Employee to a maximum amount equal to the basic periodic rate of pay for the period of notice.
38.2.5 Where an employer has given notice of termination to an employee, the employee shall be allowed up to one day’s time off during the notice period without pay to seek other employment.

39.2.2 Where notice has been given by the Employer, instead of requiring an Employee to continue in employment until such notice expires, the Employer may pay the wages equivalent to the required period of notice.
39.2.3 The Employee shall terminate employment at one (1) weeks’ notice, at any time during the week, or by payment, or forfeiture as the case may be, of a week’s basic periodic rate of pay for nominal hours worked.
39.2.4 If the Employee fails to give notice the Employer has the right to withhold monies due to the Employee to a maximum amount equal to the basic periodic rate of pay for the period of notice.
39.2.5 Where an Employer has given notice of termination to an Employee, the Employee shall be allowed up to one day’s time off during the notice period without pay to seek other employment.

Entitlements on Termination. (a) On termination of this agreement in accordance with clause 26.2 or 26.3, the Executive shall be entitled to receive from the Company:

On termination of this Agreement pursuant to this clause 12, the Audit Service Provider will only be entitled to the Audit Fee payable pursuant to clause 7 for any work satisfactorily performed by the Audit Service Provider up to the date of the termination but not compensation for any loss of profits or other benefits.

If the Agreement is terminated under clause 23.1(a), the parties remedies, rights and liability shall be the same as they would have been under the law governing the Agreement had the defaulting party repudiated the Agreement and the other party elected to treat the Agreement as at an end and recover damages. If the Agreement is terminated under clause 23.1(b), RQ must pay for Services performed up to the time of termination and the direct costs reasonably and necessarily incurred by the Provider (which the Provider must provide written evidence of) in closing out the Services (including necessary wind down activities) in accordance with RQ's written instructions and the amounts payable will be the Provider's sole remedy for termination of this Agreement by RQ under this clause 23. RQ may either carry out the remainder of the Services itself or may engage another contractor to perform any part of the Services in respect of which this Agreement is terminated without being in breach of this Agreement.
