Equal and Ratable Sharing of Collateral by Holders of Parity Lien Debt Clause Samples

The "Equal and Ratable Sharing of Collateral by Holders of Parity Lien Debt" clause ensures that all creditors holding debt secured by the same collateral and ranking equally (parity lien debt) share the collateral on a proportional basis. In practice, if the collateral is liquidated or otherwise distributed, each holder receives a share corresponding to the amount of their outstanding debt relative to the total parity lien debt. This clause prevents any single creditor from receiving preferential treatment over others with the same security interest, thereby promoting fairness and reducing disputes among creditors in the event of enforcement or bankruptcy.
