Equal materials, equipment, or assemblies Clause Samples

The 'Equal materials, equipment, or assemblies' clause ensures that any materials, equipment, or assemblies used in a project are of equal quality and performance to those specified in the contract documents. In practice, this clause allows contractors to propose alternative products or systems, provided they meet or exceed the standards and characteristics of the originally specified items. This provision helps maintain project quality while offering flexibility in sourcing, and it addresses the need for substitutions due to availability, cost, or other practical considerations, ensuring that the end result is not compromised.
Equal materials, equipment, or assemblies. Whenever in these Contract Documents, a particular brand, make of material, device or equipment is shown or specified, such brand, make of material, device or equipment shall be regarded merely as a standard. Any other brand, make ormanufacturer of a product, assembly or equipment which in the opinion of the Owner is the equal of that specified, considering quality, capabilities, workmanship, configuration, economy of operation, useful life, compatibility with design of the Work, and suitability for the intended purpose, will be accepted unless rejected by the Owner as not being equal.
