Equipment Attachment to Node Poles. City hereby grants to ExteNet the nonexclusive right, privilege, and license to enter and occupy City’s Rights-of-Way on Node Poles identified in Schedule 1 hereto or as approved by the City and/or CMA in the future. Such right to enter and occupy shall be for purposes of, and/or in connection with, Attachments of Equipment to Node Poles, and shall be subject to applicable rules, regulations or statutes setting forth non- discriminatory and reasonable controls as to the time, place and manner in which City’s Rights- of-Way are accessed and occupied in order to protect the health, safety and welfare of the public.
