Common use of ESP Clause in Contracts

ESP. A childcare leave of absence shall be granted by the Board for a period of time mutually agreed upon between the employee and the Board with recognition for natural breaks in the school year. In the case of pregnancy, the unpaid childcare leave shall commence at the termination of the disability period, for which sick leave may be used and for a period as mutually agreed. All insurance coverage shall continue while on such leave during the FMLA period, except the employee shall be required to pay the cost of the employee portion of the premiums. In the event that an employee elects not to return to work upon completion of an approved unpaid leave of absence, the Board may recover from the employee the cost of any payments made to maintain the employee’s coverage, unless the failure to return to work was for reasons beyond the employee’s control.
