Evaluations and Observations Clause Samples
The "Evaluations and Observations" clause establishes the right or obligation for one party to assess, monitor, or review the performance, progress, or compliance of the other party under the agreement. In practice, this may involve site visits, performance reviews, or the submission of progress reports, allowing the evaluating party to gather information and ensure standards are being met. The core function of this clause is to provide oversight and accountability, helping to identify issues early and ensure that contractual obligations are being fulfilled as intended.
Evaluations and Observations. Adjunct employees shall be evaluated by the ▇▇▇▇ (or designee). Evaluations of librarians/counselors and adjunct faculty will normally occur on a two year cycle. Multiple methods of evaluation may be implemented for adjunct employees including but not limited to goal-based self-evaluation and reverse peer observation. The procedures for these methods of evaluation will be documented on the Academy for Teaching Excellence website and in the adjunct employee handbooks. Adjunct employees will be notified during the first week of classes in the semester they are due to be evaluated. Individual classroom observations and/or evaluations may be conducted as determined necessary by the division ▇▇▇▇. The ▇▇▇▇ shall inform the adjunct employee in writing of the reason(s) for any additional observations or evaluations. When a written report of an evaluation or observation is prepared, a copy of the written report shall be concurrently provided to the adjunct employee, department chair and division ▇▇▇▇. The adjunct employee shall acknowledge receipt of such copy by signing it for the file but such acknowledgement shall not signify anything other than receipt of the report. Should the adjunct employee refuse to sign the written evaluation/observation, the ▇▇▇▇ (or designee) shall write on the written report that the adjunct employee refused to sign, date it and sign his/her name to the written report. A copy of the written evaluation or of the observation signed by the adjunct employee shall be maintained in the adjunct employee’s personnel file in the Human Resources office. An adjunct employee shall have the right to respond to the written evaluation or observation placed in his/her personnel file by submitting such response in writing within fourteen (14) days of the receipt of the original material. Such response shall be attached to the file copy. As used in this paragraph, “days” shall mean Monday through Friday on days when credit classes are in session. When a written evaluation of classroom observation is prepared, a copy of this written evaluation shall be discussed with and provided to the adjunct employee within (30) calendar days of the observation whenever possible. Evaluations and Observations. Evaluation forms utilized for bargaining unit members are attached hereto as Addendum B. The University shall consult with the Union prior to implementing any amendments to the evaluation procedures or forms. Each school/college should clearly communicate to their adjuncts what the process and bases for their evaluation will be. Specifically, each school/college should send a communication to adjunct faculty at the start of the semester that explains the process and includes the form(s) that will be used. Any evaluation procedure that involves peer review shall be subject to consideration by the respective Faculty Council(s)8 and approval by the President. Newly hired adjunct faculty members teaching in the Fall and/or Spring semesters shall receive a minimum of two (2) in-class peer observations within the first four (4) semesters of teaching in a Department unless they are retired Pace full-time faculty teaching in the same Department from which they retired or unless they are assigned to a clinical site off campus. In the case of such retirees, the minimum number of observations need not be made. In subsequent semesters, the Chair may require an in-class peer observation. In the case of adjuncts assigned to clinical sites or the simulation laboratory, the Chair may use other methods of observation including feedback from clinical site supervisors, the simulation center director, and faculty course coordinators.

Evaluations and Observations. The Director of Special Education, or designee, shall evaluate employees. All employees shall be evaluated by direct observation where applicable and by personal conference with the Director of Special Education or designee. The completed evaluation form based on any or all of the following: (1) two (2) formal scheduled observations at least sixty (60) days apart, unless a shorter interval between the two (2) classroom observations if mutually agreed upon by the employee and the Director of Special Education or designee; (2) discussion;
Evaluations and Observations. A. The performance review process provides the employee and their supervisor the opportunity to review an employee’s performance on key competencies and specific job skills. During this review, each party will have the opportunity to discuss the performance during the evaluation period and areas to develop in the upcoming year.
B. All unit members will be evaluated. The evaluation shall be conducted by their supervisor or their designee, through a performance review process which may include announced and/or unannounced observations.
C. The evaluator and the unit member shall review and sign the written evaluation at the time of the conference to acknowledge that they have reviewed it. In the event a unit member refuses to sign the evaluation or attend the conference mentioned above, such refusal may be noted on the evaluation, but the evaluation shall still be placed in the file.

Evaluations and Observations. 21.01 Due to the unique circumstances surrounding the crisis, Unit members will be evaluated only on the usual California Standards for the Teaching Profession and such aspects of teaching as lesson planning, implementation, delivery, and/or student assessment. They will not be evaluated with any new technology or skill associated with distance learning.
21.02 Administrators will be conducting observations and classroom visits as they would during a regular school year. If an employee has been cleared to work from home during distance learning, administrators will have access to observe those classes in Zoom remotely.

Evaluations and Observations. The following provisions shall constitute the program for the evaluation and observation of employees for the purpose of improvement in job performance.
A. Formal evaluations will only be conducted by the staff member’s immediate supervisor. Head custodians, head cooks, and maintenance team leaders will not be responsible for employee evaluations. Custodians, secretaries, and paraprofessional employees will be evaluated by building principals. However, career tech paraprofessionals shall be evaluated by the Career Tech Director. Maintenance employees will be evaluated by the Facilities Manager. Food Service employees will be evaluated by the Director of Food Service or Assistant Food Service Manager.
B. Each employee new to the Mansfield City School District shall be observed and evaluated by one (1) or more persons on at least two (2) separate occasions.
C. All other employees shall be observed and evaluated at least once yearly.
D. The evaluation form will include a space to summarize deficiencies and a space to summarize progress in correcting deficiencies. The employee may respond on the same form.
