Events Not Considered As Excusable Delay. The following events shall not constitute Excusable Delay, and Design-Builder assumes all risk of such events: (1) Actions or inactions of Government Units except as provided in Section 10.7(10); (2) Delays in obtaining or delivery of goods or services from Design-Builder or any Subcontractor unless such delay is caused by an Excusable Delay encountered by the Subcontractor; (3) Economic conditions, including labor shortages, inexperienced or unqualified labor, material shortages, or increases in the prices of labor or material. (4) Delays of common carriers; (5) Delays or disruptions arising out of or related to security clearances at the Site unless such delays or disruptions are not due to the actions or omissions of the Design-Builder or its subcontractors; (6) Adverse weather conditions, except as provided in Sections 10.7(6) and 10.7(7); and (7) Any other delay not specifically enumerated in Section 10.7.
