Common use of Exclusion from Physical Fitness Program Clause in Contracts

Exclusion from Physical Fitness Program. A part-time employee who has a medical problem that prevents him/her from participating or necessitates limited participation in the Physical Fitness Program must submit a doctor’s statement through the Chain of Command to the Fire Chief or his designee. The doctor’s statement must explain the reasons(s) for the exclusion, or limited participation, the treatment being given and the employee’s prognosis. The Fire Chief and Human Resources will determine if the individual is able to remain on duty according to the requirement of the Americans With Disabilities Act and other applicable laws and a fitness for duty evaluation performed by the City’s Occupational Medicine Provider may be requested by the City.
