Exercise of Remedies Not Release Clause Samples
The "Exercise of Remedies Not Release" clause establishes that a party’s use of one contractual remedy does not prevent it from pursuing other available remedies under the agreement or at law. In practice, this means that if a party enforces a right—such as seeking damages or specific performance—it does not forfeit the ability to pursue additional remedies for the same breach or related breaches. Exercise of Remedies Not Release. Notwithstanding anything to the contrary contained herein, the exercise by the Administrative Agent, the Collateral Agent, each Lender and the Secured Parties of their rights hereunder or any other Facility Document shall not release the Collateral Manager or the Borrower from any of their duties or responsibilities with respect to the Collateral. The Secured Parties, the Administrative Agent, each Lender and the Collateral Agent shall not have any obligation or liability with respect to any Collateral, nor shall any of them be obligated to perform any of the obligations of the Collateral Manager hereunder.
