Common use of Existing Foundations, Structures and Work Clause in Contracts

Existing Foundations, Structures and Work. Contractor shall be solely responsible for the consequences of incorporating into the Work any existing foundations, structures, Equipment or Materials including any existing piling, floor slabs and culverts. To the extent that the same are incorporated into the Work, such pre-existing items shall be subject to the conditions as if they were supplied by Contractor hereunder. Contractor shall notify Company of its intention to incorporate any existing foundations, structures, Equipment or Materials into the Work other than those specifically identified in the Contract as soon as is reasonably practicable and shall seek the prior written consent of Company for the use or utilization thereof, which consent may be withheld in the sole discretion of Company.
