Experience Formula Sample Clauses

The Experience Formula clause defines a method for calculating adjustments to contract terms, such as pricing or compensation, based on the actual experience or performance data gathered during the contract period. Typically, this clause applies to situations where costs or outcomes can vary, such as insurance premiums being recalculated based on claims history, or service fees being adjusted according to usage levels. Its core practical function is to ensure that contract terms remain fair and reflective of real-world results, thereby allocating risk more equitably between the parties and incentivizing accurate reporting and performance.
