FACILITY DESIGN AND CONSTRUCTION. The Developer shall design and construct all On-Site and Off-Site utility infrastructure described in the Special Conditions, including any oversizing, in accordance with the USR and all applicable local, state and federal requirements. Developer further recognizes that SAWS’ approval in all respects as to facility right-of-way adequacy, location, size, grade and invert elevation is a condition precedent to any further obligation of SAWS. Specific design and construction requirements are set forth in the Special Conditions.
FACILITY DESIGN AND CONSTRUCTION. All Proposers shall submit the following preliminary conceptual plans for each proposed location/concept in sufficient detail to facilitate evaluation of the design and quality of the proposed improvements: Conceptual architectural rendering and space layouts of each proposed location. Include the following: Exterior: Full-color rendering of the storefront and the surrounding area that depicts the immediate exterior of the concession. Interior: same as above. Each such rendering also shall indicate: • The overall design concept for the space • general color scheme • internal layout showing access and egress routes, fixtures, counters, circulation, table and displays. • Graphics and any other signage. • photographic copies of material boards detailing the type, character and composition of the materials to be used in construction. (Note: actual material boards may be requested by the Airport). CAPITAL INVESTMENT COMMITMENT: Provide a table that includes, for each facility location: • Facility Name/Brand • Facility location, using the location numbers identified in Exhibits B1 and B2 of this RFP • Square feet to be developed for public service use • Square feet to be developed for support/storage use • Total amount to be expended for improvements, exclusive of architectural, engineering and any in- house construction or design fees (“hard costs”) • Total amount to be expended for architectural, design, consultants, engineering, program management and construction related fees (“soft costs”) • Total Capital Investment Commitment for each location. Please note, the capital investments for each space are requested under this section to help clarify the concept mix for each location. The scoring assigned to this capital investment will be applied under the “Minimum Annual Guarantee & Capital Investment” selection criteria weighted at 35%. CONSTRUCTION SCHEDULE AND PHASING PLAN: Proposers shall provide an estimated construction schedule for the proposed facilities showing how design and construction will be expedited and a detailed graphic for each phase of development must be submitted summarizing the construction phasing. Proposal Section 4, Staffing, Operations, and Customer Service Plans, Proposer must provide detailed information with regard to how the proposed operations will be managed. FACILITY DESIGN AND CONSTRUCTION. The County after consultation with and input from the YMCA, shall design and oversee the construction of the facilities, including architectural, engineering, site design, stormwater management, utilities, permitting, bids, bid award and processing and all other matters related to the design and construction of the facility.
FACILITY DESIGN AND CONSTRUCTION. The Facility will be designed, -------------------------------- constructed and equipped on Contractor's site in accordance with the Builder's plans and specifications set forth in Builder's best and final offer to construct the Facility (Attachment B). The Facility shall be constructed as two (2) 48-bed residential units (totaling 96 beds) and an integrated central core unit, which is designed and equipped to support potential future expansion by two (2) additional 48-bed residential units (total expansion capacity to 192 beds). FACILITY DESIGN AND CONSTRUCTION. A. The Authority shall function as the Project Manager for this project and shall retain all architects, contractors, engineers, environmental compliance and/or other professionals associated with the construction, construction management, design, environmental compliance or site selection to establish the appropriate site and cost of the Facility. B. As the location, design, engineering and specifications of the Facility are not identified at this time, the Members and Authority agree that all designs and specifications for Facility will be jointly developed and approved prior to the procurement or commitment of funds for architects, contractors, engineers, environmental compliance and/or other professionals associated with the construction, construction management, design, environmental compliance or selection of site. Authority acknowledges that County’s review and approval of Facility designs and specifications shall include review by County’s Department of Architecture and Engineering, and Authority agrees to reimburse County for costs related to such review. C. Authority agrees to engage in a competitive bid process pursuant to the Public Contract Code for all Facility-related project expenses including, but not limited to, construction, construction management, design, environmental compliance, site selection, and project close out, and that the results of such competitive bid process shall be jointly reviewed and approved by the Members prior to the selection of vendors and/or the awarding of contracts. D. Authority will make all accounting records, charges, project budgets, reports including audit reports, and transaction costs related to the Facility project, available for inspection and copying by the Members within receipt of seventy-two (72) hours’ prior written notice. E. It is further agreed by the Parties that continued funding for this project beyond Year 1 is dependent upon the Authority making significant progress toward the successful development and construction of the Facility. The following benchmarks have been established to monitor the Authority’s performance for this project: 1. Site Selection: to be completed within twelve (12) months from effective date of this Agreement. 2. Environmental Compliance: to be completed within twenty-four (24) months from effective date of this Agreement. 3. FACILITY DESIGN AND CONSTRUCTION. The target the substantial completion date for the Facility is January 15, 2019. The Braves and County have and will participate in design and construction meetings with approval rights of all material development, design and construction documents as well as change orders. The Braves will serve as the construction administrator. All warranties will be assigned to the County along with the Facility and the Site at transfer to the County. The Braves have the option to make an upfront cash contribution to reduce their annual license fee for use of the Facility. The fee corresponds to the outstanding debt service on the funding for the Facility. After the debt is retired and if the term is extended, the Braves would pay the County $250k annually in years 31-40, which would be reinvested into the Facility as mutually agreed by the Braves and the County.
FACILITY DESIGN AND CONSTRUCTION. A. All Operating Facilities and Fixed Improvements to the Premises to be constructed or altered by the Contractor, and the plans and specifications therefore, including the size, location, text, material, and appearance of any signage, shall be submitted to the Authority prior to any such construction, alteration, or installation. Following approval by the Authority, such Operating Facilities and Fixed Improvements shall be installed, in strict accordance with such plans and specifications, and in accordance with all applicable building code regulations, county, state and federal laws, ordinances and regulations, and with all applicable provisions of the Authority's Design Manual in effect at the time of the construction, alteration, and installation. B. The Contractor shall initially propose conceptual plans for the proposed Fixed Improvements and Operating Facilities. Following concept approval by the Authority, the Contractor shall develop detailed plans and specifications, calculations and code review to the Authority. FACILITY DESIGN AND CONSTRUCTION. 1. CILCORP's Obligations (a) CILCORP shall finance, build, own, operate and maintain a Boiler Plant on the Leased Site. CILCORP shall be responsible for purchasing and installing all equipment and fixtures at the site, as well as all labor costs and overhead associated with constructing, operating, and maintaining the Boiler Plant. (b) The Boiler Plant shall have two 185,000 pounds per hour gas-fired steam boilers and one 175,000 pounds per hour gas-fired steam boiler to provide steam heat to MWG. CILCORP, at its option, may install additional boilers on the Leased Site. Unless the parties otherwise agree in writing, such additional boilers shall not be deemed to be constructed to provide steam heat to MWG and may be used exclusively to produce steam for sale to or use by others. The parties agree that CILCO is authorized, pursuant to provisions of the Cogeneration Agreement among CILCORP, CILCO, and MWG dated December 16, 1993 and attached hereto as Exhibit B, to install, own, operate and maintain electric generating units on the Leased Site, which generating units will be driven by the steam produced by the boilers installed on the Leased Site, including those constructed to provide steam heat to MWG, provided such use does not unreasonably interfere with the delivery of steam to meet MWG's requirements for steam heat. (c) CILCORP, at its own cost and expense, shall secure all permits necessary to construct the Boiler Plant, except to the extent such permits are obtainable only by MWG or MWG already has obtained construction or operating permits which CILCORP might use, in which event the permits shall be supplied by MWG without charge to CILCORP. (d) CILCORP shall use reasonable efforts to have the Boiler Plant operational by December 31, 1994. 2. MWG's Obligations (a) MWG shall execute the Lease Agreement attached hereto as Exhibit A, leasing to CILCORP the land necessary for the Boiler Plant and providing reasonable access to the Leased Site to permit CILCORP and CILCO to fulfill their obligations under this Agreement and the Cogeneration Agreement, including but not limited to, making necessary interconnections and operating their respective equipment. (b) MWG shall provide CILCORP with such assistance as may be reasonably requested by CILCORP to obtain permits required for CILCORP's performance under this Agreement, and MWG agrees to transfer to CILCORP, without charge to CILCORP, any existing construction and/or operating permits for the project. FACILITY DESIGN AND CONSTRUCTION. Contractor shall furnish, on a turnkey basis, all products and services required to perform the Work and turn over to Owner the Facility in a manner which shall: (a) enable the Plant to meet the Performance Tests by the Plant's Guaranteed Commercial Operation Date; (b) be in conformance with the Scope of Work, the Addendums to the Scope of Work, the Design Contract attached hereto as Exhibit C, and (c) all Applicable Permissions and Applicable Laws.
