Common use of Failure to Appoint Clause in Contracts

Failure to Appoint. If the party receiving the notice fails to appoint a nominee or if the two (2) nominees fail to agree upon a Chairperson within seven (7) days of their appointment, the appointment shall be made by the Minister of Labour upon request of either party.

Failure to Appoint. If the party receiving the notice fails to appoint a nominee an arbitrator, or if the two (2) nominees appointees fail to agree upon a Chairperson chair within seven (7) working days of their appointment, the appointment shall be made by the Minister of responsible for Labour upon request of either party.
