Common use of Familiarity with Work Clause in Contracts

Familiarity with Work. By executing this Agreement, Consultant represents and warrants that Consultant (i) has thoroughly investigated and considered the Services to be performed, (ii) has carefully considered how the Services should be provided and (iii) fully understands the facilities, difficulties and restrictions attending the provision of the Services under this Agreement. Should the Consultant discover any latent or unknown conditions materially differing from those inherent in the provision of such Services or as represented by the City, Consultant shall immediately inform the City of such fact and shall not proceed except at Consultant’s risk until written instructions are received from the City.

Familiarity with Work. Consultant represents and warrants that Consultant (i) it has thoroughly investigated and considered the Services to be performedscope and nature of the Services, (ii) has carefully considered how the Services should be provided performed and (iii) fully understands the facilities, difficulties facilities and restrictions attending the provision associated with performance of the Services under this Agreement. . B. Should Consultant, subsequent to the Consultant execution of this Agreement, discover any latent or unknown conditions that may materially differing from those inherent in affect the provision performance of such the Services or as represented by the Cityhereunder, Consultant it shall immediately inform the City of such fact and shall not proceed without written instructions from City except at Consultant’s risk until written instructions are received from the Cityits own risk.
