Common use of FIELD ASSISTANCE Clause in Contracts

FIELD ASSISTANCE. If applicable, Subcontractor shall provide the technical field service representatives (“field service representatives or field service representative”) identified in Attachment C as part of the Work. Any field assistance days are based on ten (10) working hours per day, fifty (50) hours per week. Overtime must be approved by Contractor, in writing. Any unused days remaining at the Project’s final completion shall be credited to Contractor at the rates listed in Attachment C. If additional days are needed, Contractor shall be billed at the rates listed in Attachment C and in accordance with Section 4. When, in Contractor’s judgment, a field service representative's time is required to direct corrective action under a Warranty or guarantee, this will not be considered a field assistance day. Work performed for directing any corrective action, or providing services required as a condition to providing the Warranties and guarantees, is within the Agreement Price. Subcontractor's field service representatives shall follow Contractor's prescribed procedures on keeping records of service time and activities of service personnel while at the Project Site and shall provide Contractor a written timesheet and daily report of the Work performed each day. Contractor’s superintendent for the Work must sign and approve all time expended to validate for reimbursement. Unsigned timesheets will not be paid. Further, field service representatives must obtain written approval from Contractor’s superintendent (or an authorized representative senior to superintendent) for any period spent away from the Project Site (other than normal off-time) and advise Contractor’s superintendent how field service representatives can be reached in the event of an emergency. Prior to the start of any operations in the field, Subcontractor’s field service representatives must attend safety orientation sessions with Contractor's Project Site representative. Subcontractor’s field service representatives shall be: (i) competent, English speaking individuals satisfactory to Contractor; and (ii) Subcontractor’s authorized representatives shall have the authority and responsibility to accept Work installed at each step of the installation process (i.e., co-signing with Contractor any quality assurance and verification documentation). Subcontractor's field service representatives shall have the authority and responsibility to authorize remedial or extra work Contractor performs on Subcontractor’s behalf. Subcontractor's field service representatives shall also have the responsibility to sign timesheets on Subcontractor’s behalf. The duties of Subcontractor’s field services representatives shall include, but will not be limited, to the following: abiding by all Contractor, Owner and OSHA safety rules and policies; signing on to the crew job safety/hazard analysis for the Work being inspected on a daily basis; providing notice of inspection hold points for critical installations regarding the Work being assembled or installed; understanding and agreeing to Contractor requested hold points and sign offs in the event there are additional requirements from either Owner or Contractor above and beyond those Subcontractor requires; providing any inspection forms required in the event Contractor’s inspection forms do not meet Subcontractor’s requirements, provided Subcontractor’s forms are acceptable to Contractor; signing off on all hold points as appropriate and agreed upon as Work progresses; signing off on all material receiving reports, shipping reports, over/short/damaged reports and any other material management reports necessary for documenting receipt and condition of Subcontractor provided materials in coordination with Contractor’s material management personnel; providing any unique or special information for rigging any Subcontractor component for unloading or erection including, but not limited to, center of gravity, component weight, special instructions as to rigging attachment points or rigging configuration and any other special handling instructions; providing to Contractor any required information regarding handling, storage and maintenance of any Subcontractor components thirty (30) days in advance of delivery; providing input as to the breakout of the Work into systems or sub-systems for commissioning and start up; providing on a daily basis a report detailing: (1) time of arrival on the Project Site; (2) time of departure, inspections made and the results of those inspections; (3) deficiencies noted and suggested corrective action; (4) conversations with Contractor supervision or Owner personnel; and (5) any other pertinent observations regarding safety, quality or progress; attending all required meetings on the Project Site including, but not limited to, coordination meetings, task planning meetings, start-up or commissioning meetings, planning meetings, safety meetings, morning tool box meetings and any meetings called to resolve any issue pertinent to the Work; providing technical advice to assist the erection contractor with installing the equipment; inspecting and testing the equipment after installation and directing any changes or adjustments necessary for proper operation; providing technical direction during startup and initial operation of the equipment; directing any corrective action under any Warranty; instructing the Owner's personnel in the operation and maintenance of the Work; providing services required as a condition to providing the Warranties and guarantees; making any required programming changes to the application software provided as part of the Work; and submitting a service report to the Contractor’s startup coordinator stating whether or not the Work, or any part of the Work, is ready for operation.
