Common use of Filling of Regular Vacancies Clause in Contracts

Filling of Regular Vacancies. ‌ (a) The Employer shall fill regular vacancies in each seniority block, and/or any vacancies created as a result of an employee using this article. The Employer agrees to fill the vacancies or new positions from within the seniority block within thirty (30) days and from outside the seniority block within forty-five (45) calendar days. (b) Absences on Long-Term Disability or Workers' Compensation Board benefits will be considered a regular vacancy pursuant to (a) above, on the date the employee is determined to be permanently disabled from his own occupation, or upon the expiry of two (2) consecutive years from the date an employee commenced on Long-Term Disability. (c) Effective on ratification and until the regular employee complement reaches 17 the provisions of Clause 12.1(d) and (e) will be exercised at the sole discretion of the Employer.
