Flats. 4.1.1 The following are the easements, rights and privileges subject to which each Undivided Share and the exclusive right to hold, use, occupy and enjoy each Flat is held :- (a) The Manager shall have the right at all reasonable times on reasonable notice (except in the case of emergency) with or without agents, surveyors, contractors, workmen and other authorized persons and with or without tools to enter into and upon the Flats or any part or parts thereof for the purposes of (i) inspecting, testing, repairing, replacing, renewing, painting, decorating, cleaning, examining, maintaining and improving as well as abating any hazard or nuisance which are affecting or likely to affect the Residential Tower or the Estate or any part or parts thereof or the General Common Areas and the General Common Facilities or (ii) to implement the Fire Safety Management Plan; causing as little disturbance as possible and forthwith making good any damage caused thereby at its own costs and expense causing as little disturbance as possible and the Manager shall be responsible for liability arising therefrom including liability for the negligent, wilful or criminal acts of the Manager, its staff, contractors, agents, surveyors and workmen. (b) The Manager shall have the full right and privilege at all times to extend, maintain, operate, move and have access to, over and /or into or partly into the portion of airspace above the roof and/or flat roof or the parapet walls of the roof and/or flat roof as may be determined by the Manager the gondola or such building management equipment or units to service, cleanse, enhance, maintain, repair, renovate, decorate, improve and/or replace any part of any exterior of the Estate, and to remain temporarily over and/or on the said airspace for such period as may be necessary for the purpose of inspecting, rebuilding, repairing, renewing, maintaining, cleaning, painting or decorating all or any part of the General Common Areas and General Common Facilities PROVIDED THAT the use and enjoyment by the Owner of the Flat shall not be unreasonably affected or prejudiced thereby. (c) Easements, rights and privileges over, along and through each Flat equivalent to those set forth in paragraphs (b) and (c) of Clause 3.1.1. (d) Exceptions and reservations in favour of the Government under the Government Grant. (e) The rights of the First Owner under this Deed.

(a) The Manager shall have the full right and privilege at all reasonable times on reasonable notice (except in the case of emergency) with or without agents, surveyors, contractors, workmen and other authorized persons and with or without tools others to enter into and upon the Flats or any part or parts thereof for the purposes of (i) inspecting, testing, repairing, replacing, renewing, painting, decorating, cleaning, examining, maintaining maintaining, repairing and improving as well as abating any hazard or nuisance which are affecting or likely to affect of the Residential General Common Areas within the Tower Accommodation or the Estate or any part or parts thereof or any of the common facilities therein or any other apparatus and equipment used or installed for the benefit of the Estate or any part or parts thereof as part of the amenities thereof which are not for the sole use and enjoyment of any individual Owner or to ▇▇▇▇▇ any hazard or nuisance which does or may affect the General Common Areas and the General Common Facilities or (ii) to implement other Owners provided that the Fire Safety Management Plan; causing as little Manager shall ensure that the least disturbance as possible is reasonably practicable is caused and forthwith making shall be liable for and shall at his own expense make good any damage caused thereby at its own costs and expense causing as little disturbance as possible and the Manager shall be responsible for liability arising therefrom including liability for by the negligent, wilful or criminal acts of the Manager or the Manager, its 's staff, contractorsemployees, agents, surveyors agents or contractors to the relevant Flat(s) and workmenreinstate the same causing the least disturbance as is reasonably practicable.
(b) Easements, rights and privileges over, along and through each Flat equivalent to those set forth in paragraphs (b) and (c) of Clause 3.2.1.
(c) The full rights and privileges of the Director of Lands and his officers, contractors and any other persons authorised by him, of ingress, egress and regress to, from and through the Land for the purpose of inspecting, checking and supervising any works to be carried out under the Conditions.
4.2.2 Subject always to the provisions of this Deed, the Manager shall have the full right and privilege at all times to extend, maintain, operate, move the gondola (if any) and have access to, over and /or and/or into or partly into the portion of airspace above the roof and/or or flat roof or top roof of the Tower Accommodation or the parapet walls of the roof and/or or flat roof or top roof of the Tower Accommodation as may be determined by the Manager the gondola or such building management equipment or units to service, cleanse, enhance, maintain, repair, renovate, decorate, improve and/or replace any part of any exterior of the Estate, and to remain temporarily over and/or on the said airspace for such period as may be necessary for the purpose of inspecting, rebuilding, repairing, renewing, maintaining, cleaning, painting or decorating all or any part of the General Common Areas and General Common Facilities PROVIDED THAT provided that the use and enjoyment by the Owner of the Flat shall not be unreasonably materially adversely affected or prejudiced thereby.
(c) Easementsthereby provided further that the Manager shall ensure that the least disturbance as is reasonably practicable is caused and shall be liable for and shall at his own expense make good any damage caused by the negligent, rights and privileges overwilful or criminal acts of the Manager or the Manager’s staff, along and through each Flat equivalent employees, agents or contractors to those set forth in paragraphs (bthe relevant Flat(s) and (c) of Clause 3.1.1reinstate the same causing the least disturbance as is reasonably practicable.
(d) Exceptions and reservations in favour of the Government under the Government Grant.
(e) The rights of the First Owner under this Deed.
