For Subscription Services. For any subscription service offered by our Partner through us, you hereby authorize our Partner to bill your payment instrument in advance on a periodic basis in accordance with the terms of the applicable payment plan associated with such subscription service until you terminate your account or the service with our Partner, and you further agree to pay any charges so incurred or as required by our Partner. If you dispute any charges with our Partner you must let our Partner know within our Partner’s payment dispute window. Know that our Partner may use Tile Five to setup recurring billing and to charge the fees for subscription services. Our Partner sets the prices for products and services, including any subscription service previously purchased by you. Tile Five reserves the right to charge additional fees for the convenience of using this Service and/or any related products as agreed to between our Partner and Tile Five. All prices for products and services are set by our Partner and as such questions about purchases should be addressed to the gym.

For Subscription Services each Subscription Service shall commence on its Subscription Start Date and shall (except as expressly provided otherwise in the Agreement) continue for its Subscription Initial Period. At the end of the Subscription Initial Period the Subscription Services shall automatically extend for further Subscription Renewal Periods unless either party gives written notice of at least the Subscription Notice Period (or 90 days if no Subscription Notice Period is specified) such notice to expire at the end of the Subscription Initial Period or then- current Subscription Renewal Period. Where no Subscription Start Date is set out in the Proposal for a particular Subscription Service that date shall be: (a) if the Subscription Service is purchased together with inspection services, the date on which the first inspection report is published by Above Surveying, and the Subscription Initial Period shall run from the date the final inspection report is published; (b) if the Subscription Service is purchased separately from any inspection services, the date on which the first payment is received in respect of that Subscription Service.

  • Subscription Service PROS warrants that during the Subscription Term, the Subscription Service will conform in all material respects to the functional specifications set forth in the Documentation. Customer's sole and exclusive remedy will be the deployment of a corrected version of the PROS software application that is the object of the Subscription Service, or provision of a workaround, provided however if PROS fails to provide such remedy after using commercially reasonable efforts, Customer may exercise its rights herein for breach of contract, including, but not limited to, termination pursuant to Section 10.2.

Red Hat Storage Server is not supported on non- server hardware such as desktops or workstations. Red Hat Storage Server for On-Premise is intended for use on a dedicated System, Physical Node, Virtual Node or Virtual Guest; running other applications and/or programs of any type on the System, Physical Node, Virtual Node or Virtual Guest can have a negative impact on the function and/or performance of the Red Hat Storage Server and is not a supported Use Case. Each Red Hat Storage Server Subscription includes one Software Subscription to Red Hat Enterprise Linux Server and the Scalable File System Add-on, which are supported solely in connection with the use of Red Hat Storage Server. Red Hat Storage Server for Public Cloud Red Hat Storage Server for Public Cloud is intended to be used as a storage system and will be supported only when used as a storage node. When running in Amazon Web Services, an EC2 M1 Large dedicated instance is required in order to be supported. Running other applications and/or programs of any type on the same instance can have a negative impact on the function and/or performance of the Red Hat Storage Server and is not a supported Use Case. Each Red Hat Storage Server Subscription includes one Software Subscription to Red Hat Enterprise Linux Server and the Scalable File System Add-on, which are supported solely in connection with the use of Red Hat Storage Server.   • Call Center Services Answer telephone inquiries during mutually agreed upon hours each day on which the Fund is open for trading. In the event that the Fund plans to be open on a business day when the New York Stock Exchange is to be closed, the Fund shall provide the Transfer Agent with reasonable advance notice and the parties shall discuss the call center resources available for such day. The Transfer Agent shall answer and respond to inquiries from existing Shareholders, prospective Shareholders of the Fund and broker-dealers on behalf of such Shareholders in accordance with the instructions provided by the Fund to the Transfer Agent for purpose of fulfilling its duties under this Agreement, including, accepting transaction requests on behalf of the Fund.
