Free from Encumbrances Clause Samples
The 'Free from Encumbrances' clause ensures that the property or asset being transferred is not subject to any third-party claims, liens, mortgages, or other legal burdens at the time of transfer. In practice, this means the seller guarantees that there are no outstanding debts, legal disputes, or restrictions affecting the asset, and that the buyer will receive clear and unencumbered ownership. This clause is essential for protecting the buyer from inheriting hidden liabilities and ensures a clean transfer of title or rights.
